ИЗБИРАТЕЛЬНЫЕ НОВЕЛЛЫ: ПРОГРЕССИВНЫЕ РЕФОРМЫ ИЛИ ХОЖДЕНИЕ ПО КРУГУ?

Abstract

В статье поднимается ряд актуальных проблем, связанных с последними новациями российского избирательного законодательства. Автор критически оценивает тенденции правового регулирования, которые проявляются на всех уровнях власти. Проанализированы причины возвращения законодателя к тем идеям, которые ранее уже воплощались в избирательном законодательстве и были отвергнуты. Особое внимание уделяется проблемам участия политических партий в выборах, подчёркивается необходимость дифференцированного подхода к внедрению пропорциональной избирательной системы, в частности необходимости её ограничения по выборам органов местного самоуправления. Рассмотрены проблемы совершенствования механизма выборов депутатов в Государственную Думу и глав субъектов Российской Федерации. ; The article deals with a number of urgent problems associated with the latest innovations in the Russian electoral legislation. The author critically estimates the tendencies of legal regulation that occur at all levels of government. The reasons for the legislator to return to the ideas that had already been embodied in the electoral law and were rejected have been analyzed. Particular emphasis is laid to the problems of the participation of political parties in the elections. It is stressed that there is the need for a differentiated approach to introduction of the proportional electoral system, in particular, this concerns certain limitations in the system of local authorities elections. The problems of improving the mechanism of election of the State Duma deputies and the heads of subjects of the Russian Federation are considered.
