ФОРМИРОВАНИЕ БАНКОВСКИХ ХОЛДИНГОВ В СОВРЕМЕННОЙ РОССИИ

Abstract

В России термин «холдинг» нельзя назвать вполне правовым, так как нет единого нормативного акта о холдингах. В действующем законодательстве термин встречается редко, в том числе касательно банковских холдингов и групп (Закон «О банках и банковской деятельности»). Точного определения понятия «холдинг» до сих пор нет. Таким образом, есть потребность в исследовании данного понятия и систематизации информации о банковских холдингах и холдингах в целом.В статье предлагаются результаты анализа нормативно-правового регулирования и практика формирования банковских холдингов современной России. Кроме того, выявлены критерии принятия решений при формировании банковских холдингов и проведена оценка стратегии их развития.Учитывая существенную необходимость в унификации и стандартизации правового регулирования формирования и деятельности холдингов, в частности банковских, результаты проделанного автором анализа могут быть использованы в процессах разработки и реализации политики формирования банковских холдингов в современной российской практике.In Russia the term "holding" is not entirely legal since there is no uniform regulation of holding companies in Russia, which governs their activities. The term is rarely found in existing legislation, for example, concerning bank holding companies and groups (the Law "On Banks and Banking Activity"), but the precise definition of the concept of "holding" is still not there. Thus, there is a need to study this concept and systematization of information on bank holdings and holdings as a whole.The article presents the results of the analysis of normative-legal regulation and practice of the formation of Bank holding companies in modern Russia.In addition, the article identifies criteria decision making in the formation of Bank holding companies, as well as an assessment of their development strategy.Considering the significant need for unification and standardization the legal regulation of the formation and activity of holdings, in particular bank holding companies, the results of the analysis can be used in the processes of policy development and implementation of formation of Bank holding companies in the modern Russian practice.
