ТРАДИЦИЯ БРИТАНСКОЙ КОНСТИТУЦИИ В СОВРЕМЕННОМ ПОЛИТИКО-ФИЛОСОФСКОМ ДИСКУРСЕ: НЕКОТОРЫЕ ТЕОРЕТИЧЕСКИЕ ПРОБЛЕМЫ

Abstract

При рассмотрении проблемы влияния на американский политический дискурс британской политической традиции вообще и традиции английского общего права (common law) в частности автор анализирует следующие ключевые аспекты современной теоретической дискуссии: несмотря на всестороннее обоснование в трудах Д. Покока, К. Скиннера и др. последователями Кембриджской школы политического языка идеи о преемственности американской политической культуры с более ранними традициями английской политической мысли, в США до сих пор имеется немало влиятельных теоретиков и интеллектуалов, отстаивающих тезис об исторически обусловленных радикальных отличиях американской либеральной трактовки проблем государства и права от британской. В статье, напротив, обосновывается положение о постоянном присутствии традиции древней британской конституции в современном американском политическом дискурсе и правовой культуре. ; By investigating the problem of influence of the British political tradition in general and the English common law tradition, in particular, on the American political discourse the author analyses the following aspects of modern theoretical discussion: in spite of the comprehensive substantiation in the works of J. Pocock, Q. Skinner and the other representatives of the Cambridge school of political language of idea of succession of the American political culture with the earlier traditions of the English political thought, nevertheless in the USA there are many influential theoreticians and intellectuals defending the thesis of the deep-rooted radical differences of the American liberal interpretation of the problems of state and law from the British approach. The article, on the contrary, substantiates the thesis on the continuous presence of tradition of the ancient British Constitution in the modern American political discourse and legal culture.
