Abstract

Extensive proposal for the implementation of the provisions of the Hague Convention on Private International Law in the legislation of Ukraine, for the first time a proposal for the presentation of the "New Convention on Marriage in the International Arena". ; У роботі досліджено колізійно-правовий та матеріально-правовий спосіб регулювання шлюбно-сімейних відносин з іноземним елементом, розглянуто правову основу колізійного регулювання сімейних відносин з іноземним елементом, проаналізовано особливості укладання та розірвання шлюбу з іноземним елементом, визначено колізійні питання правового регулювання відносин між батьками та дітьми, розкрито особливості правового регулювання опіки та піклування з іноземним елементом. Обґрунтовано пропозиції щодо імплементації̈в законодавство України положень Гаазької̈ конвенції із міжнародного приватного права, вперше сформульовано пропозицію щодо укладення "Нової Конвенції про укладення шлюбів на міжнародній арені".
