Lack of motivation of administrative acts in the Decentralized Autonomous Government in Ecuador ; La falta de motivación de los actos administrativos en el Gobierno Autónomo Descentralizado en Ecuador

Abstract

This paper focuses on the administrative acts issued by the Autonomous Municipal Government of Azogues Canton, during the year 2020. It is verified here, to what extent the administrative acts comply with the essential requirement of motivating their acts, as a universal and constitutional guarantee of the right to defense. Thus, the pertinent parameters were established and relevant aspects of the motivation of administrative acts were analyzed from a historical, conceptual, dogmatic, constitutional, legal and jurisprudential point of view, as a theoretical framework and state of the art. The research used a scientific approach and a qualitative methodology (case by case), based on a sample of 75% of the administrative acts issued during the year in question. Finally, conclusions and recommendations were drawn for the municipal entity to optimize the motivation of its acts, considering that they could be useful for all public sector institutions. ; El presente trabajo apunta hacia los actos administrativos emitidos por el Gobierno Autónomo Municipal del Cantón Azogues, durante el año 2020. Se verifica aquí, en qué medida el actuar administrativo cumple con el requisito imprescindible de motivar sus actos, como garantía universal y constitucional del derecho a la defensa. Así, se establecieron los parámetros pertinentes y se analizaron aspectos relevantes sobre la motivación de los Actos Administrativos desde un punto de vista histórico, conceptual, dogmático, constitucional, legal y jurisprudencial, a manera de marco teórico y estado del arte. La investigación realizó un abordaje científico y se utilizó la metodología cualitativa (caso por caso), tomando como base una muestra del 75% de los actos administrativos emitidos durante el año referido. Finalmente, se realizaron conclusiones y recomendaciones para que la entidad municipal optimice la motivación de sus actos, contando con que las mismas podrán servir para todas las instituciones del sector público.
