La STC 31/2010 y el reparto competencial Estado-Comunidades Autónomas en materia de inmigración

Abstract

El presente trabajo aborda el análisis de la STC 31/2010 sobre el Estatuto de Autonomía de Catalunya en el ámbito concreto de la inmigración. Para ello, el trabajo intenta contextualizar la Sentencia en el marco constitucional y estatutario, valorar la articulación entre la Sentencia y la reciente reforma de la legislación de extranjería mediante la LO 2/2009, y avanzar algunos de las cuestiones que en este contexto podrían derivarse de la nueva doctrina constitucional en este punto. The current study analyzes the Judgment 31/2010 of the Spanish Constitutional Court on the Statute of Autonomy of Catalonia in the specific area of immigration. In doing so, the authors start by analyzing the constitutional and statutory framework of competences on migration, the evolution of the legislation and institutions aimed at enhancing intergovernmental collaboration on the topic, and evaluates the interactions between the rationale of the Judgment and the recent reform of the Immigration Law by means of the Aliens Reform Bill 2009 (num. 2/2009). The authors try also to foresee future issues with the new constitutional jurisprudence on the topic.
