ОСОБЛИВОСТІ РОЗВИТКУ ПРАВОВОГО НІГІЛІЗМУ В УКРАЇНІ

Abstract

Nihilism in relation to law in Ukraine is rooted in the domestic philosophical and legal tradition of jusnaturalism. It was characteristic of the Ukrainian legal understanding in general, due to the historical, cultural, social and mental features of the Ukrainian national type. The most important mental values of Ukrainians were the will and desire for the truth that embodies natural law. Ukrainians have been enslaved for centuries, and therefore the laws, written norms as an expression of coercion, violence of the ruling elite against the person caused resistance and were perceived negatively. Ukrainians have always tried to coexist harmoniously with nature, to live "according to the nature of things." Depending on what values are denied or what field of knowledge we are talking about, nihilism can be moral, aesthetic, legal, political, ideological, religious. The nihilistic attitude to the law is an unjustified and deliberate humiliation of its positive role. A characteristic feature of such nihilism is the categorical and uncompromising denial, the prevalence of subjective principles with hypertrophied, clearly exaggerated doubts about the generally accepted legal norms and values. Characterizing the current state of Ukrainian society, it should be noted that due to the difficult political situation that has developed recently and social tensions, political and legal nihilism has become widespread in Ukraine. There is a tendency to reduce and minimize the role of law in society, deaxiologization of its nature, which leads to a crisis of legal consciousness, which does not allow to fully lay the foundations of a democratic state governed by the rule of law. And it turns into a cyclical process. ; Нігілізм стосовно права в Україні кореніться у вітчизняній філософсько-правовій традиції юснатуралізму. Він був характерний загалом для українського праворозуміння. Це зумовлено історико-культурними, соціальними та ментальними особливостями українського національного типу. Найважливішими ментальними цінностями українців були воля та прагнення до правди, які втілює природне право. В залежності від того, які цінності заперечуються чи про яку сферу знань іде мова, нігілізм може бути моральним, естетичним, правовим, політичним, ідеологічним, релігійним. Нігілістичне відношення до права є безпідставним та умисним приниженням його позитивної ролі. Характерною ознакою такого нігілізму є категоричність та безкомпромісність заперечення, превалювання суб'єктивних засад з гіпертрофованими, явно перебільшеними сумнівами в загальноприйнятих правових нормах та цінностях.
