Abstract

The scientific article is devoted to the analysis of the organizational and legal foundations of ensuring public safety. The transformation of the subject of administrative law and its components as a sphere of ensuring public safety through the prism of the development and formation of administrative science has been determined. The historiography of the doctrinal study of public safety as an integral part of administrative law is clarified. The influence of the norms of administrative law on the state of ensuring public safety and the possibility of transforming these norms has been established. The theoretical foundations of the functioning of the system, ensuring public safety are established: the concept of public safety is derived, an analysis of the content, goals, principles and functions is carried out, the current state of legal support of public safety is analyzed. The analysis of ensuring public safety in various administrative and legal regimes is carried out, the spheres and types of ensuring public safety are determined. The modeling of threats to public safety in time and space has been carried out. The concepts of public safety, public safety, the phenomenon of public safety, threats to public safety are proposed. Possible options for the development of threats to society in various administrative and legal regimes have been modeled. The influence of public opinion on the activities of executive authorities, which ensure public safety, has been investigated. The categories, principles, functions and methods of functioning of public opinion as an element of the system of ensuring public safety are highlighted. The mechanism for ensuring public safety has been structured as a combination of legislative, managerial, and executive elements. The levels of ensuring public safety have been systematized, proceeding from the hierarchy of executive authorities, and the limits of influence on the state of public safety have been determined. The concept and features of public safety and ensuring public safety as an integral part of administrative law have been determined. The administrative and legal bodies of executive power and their administrative legal personality in activities to ensure public security are analyzed in detail, the levels of influence of executive bodies on the state of public security have been classified, and the system for ensuring public security by executive bodies and local self-government bodies has been determined. The features of the implementation and consideration of public opinion as examples of measures to ensure public safety are determined and the main theoretical foundations of the functioning of public opinion as an element of ensuring public safety are determined. Recommendations and concepts for improving the current legislation in the field of ensuring public safety are formulated, including a number of specific proposals of a theoretical and practical nature aimed at improving the mechanism for ensuring public safety. ; В статті розглядається проблема забезпечення суспільної безпеки з позиції сучасного адміністративного права. Визначається система забезпечення суспільної безпеки як теоретичний аспект адміністративного права. Систематизуються принципи, методи та функції суспільної безпеки в адміністративному праві. Суспільна безпека подається з позиції фундаментального адміністративного права та визначається як її невід'ємний елемент. Стаття є узагальненням наукового дослідження проблематики суспільної безпеки в адміністративному праві.
