SOCIAL RESPONSIBILITY AS A COMPONENT OF THE LEGAL MODEL OF SUSTAINABLE DEVELOPMENT OF UKRAINE ; СОЦІАЛЬНА ВІДПОВІДАЛЬНІСТЬ ЯК СКЛАДНИК ПРАВОВОЇ МОДЕЛІ СТАЛОГО РОЗВИТКУ УКРАЇНИ

Abstract

In the article the author explored social responsibility as a component of the legal model of sustainable development of Ukraine. The author decided that the triune issue of sustainable development concerns economic and legal means to the greatest extent. The balance of environmental, economic and social components is a fundamental principle of the Sustainable Development Goals. The implementation of these principles in economic legislation, for the most part, focuses on the environmental component: the use of natural resources and the peculiarities of the ecology of economic activity. The author concluded that the social component of sustainable development is not given enough attention, however, according to the author, it is the most promising area. The unity of economic, social and environmental interests must be realized through an appropriate system of mutual responsibility of people, the state, society and business. The author believes that to ensure sustainable development, corporate social responsibility is no less important than a developed economic infrastructure. The article notes that most companies are focused on achieving financial results, rather than on the social perspective, because it is the financial feasibility of enterprises determines the possibilities of their existence and functioning. The popularity of corporate social responsibility, according to the author, is closely linked to the economic benefits that are achieved through the formation of socially responsible business reputation. The article analyzes the nature of social responsibility as a voluntary initiative to do more than required by law. The author believes that social responsibility is a unique phenomenon that can unite the state, society and business. The article concludes that the institution of social responsibility has the greatest impact on public relations, which are related to the UN Sustainable Development Goals, and therefore has a key role in the formation of the legal model of sustainable development of Ukraine. ; Статтю присвячено дослідженню соціальної відповідальності як складника правової моделі сталого розвит- ку України. Встановлено, що найбільшою мірою триєдина проблематика сталого розвитку стосується господар- сько-правових засобів. Баланс екологічного, економічного та соціального компонентів є основним принципом Цілей сталого розвитку. Визначено, що реалізація зазначених принципів у господарському законодавстві зде- більшого концентрується на екологічному складнику – використанні природних ресурсів та особливостей еколо- гізації господарської діяльності. Зроблено висновок, що соціальному компонентові сталого розвитку не приділено достатньої уваги, втім, саме він, на думку автора, є найбільш перспективним напрямом. Встановлено, що єдність економічних, соціальних та екологічних інтересів має реалізовуватись через відпо- відну систему взаємної відповідальності людини, держави, суспільства й бізнесу. Автором зроблено висновок, що для забезпечення сталого розвитку соціальна відповідальність бізнесу має не менше значення, ніж розви- нена економічна інфраструктура. Встановлено, що більшість підприємств орієнтовані на досягнення фінансових результатів, а не на соціальну перспективу, оскільки саме фінансова доцільність діяльності підприємств визначає можливості їх існування та функціонування. Визначено, що популяризація корпоративно-соціальної відповідальності тісно пов'язана з економічними перевагами, які досягаються завдяки побудові соціально відповідальної ділової репутації. У роботі проаналізовано природу соціальної відповідальності як добровільної ініціативи робити більше, ніж зобов'язаний за законом. Визначено, що соціальна відповідальність – це унікальний феномен, який здатен поєднати державу, суспільство та бізнес. Автором зроблено висновок, що саме інститут соціальної відповідальності найбільшою мірою впливає на суспільні відносини, які належать до Цілей сталого розвитку ООН, а тому відіграє ключову роль у процесі формування правової моделі сталого розвитку України.
