Abstract

This document brings together three institutions which, even though separate, may interconect to guarantee better standards of efficiency, quality and transparency in the procedures of public procurement in Colombia, namely: Public Procurement, Human Rights and the Democratic Principle, understood as the entity which makes the entirety of public function legitimate. It is well-known that corruption pervades all levels of the state.It is a phenomenon that alters the economic, political, legal, social and environmental scenarios in a transcendental manner, eroding the bases on which the postulates of a social democratic state and liberal tendencies, which govern all the organization in Colombia, have been built. Hence the importance of harmonizing all regulations, mechanisms and juridical, economic and social scenarios that are available to erradicate this phenomenon, or at least, mitigate its more evident consequences. ; Este documento pretende entrelazar tres instituciones que aunque autónomas, pueden interconectarse para garantizar mejores estándares de eficiencia, calidad y transparencia en el despliegue de los procedimientos de compra pública que se ejecutan en Colombia, ellos son: La contratación estatal, los derechos humanos y el principio democrático entendido como aquella figura que legitima toda función pública. Es una realidad que la corrupción se extiende en todas las órbitas que se erigen en el Estado. Se trata de un fenómeno que muta en escenarios económicos, políticos, jurídicos, sociales y ambientales, de forma tan trascendental que transgrede los cimientos sobre los cuales se han fortalecido los postulados del Estado social de derecho y las tendencias liberales que rigen toda la organización de Colombia. De ahí la importancia de armonizar todas las regulaciones, todos los mecanismos y todas los escenarios jurídicos, económicos y sociales que se tengan disponibles para erradicar este fenómeno o al menos mermar todas aquellas consecuencias que se evidencian con su continuo perfeccionamiento. ; Este ...
