REGARDING THE UNDERSTANDING OF EXPERTISE OF SOCIAL SAFETY ; ЩОДО РОЗУМІННЯ ЕКСПЕРТИЗИ СОЦІАЛЬНОЇ БЕЗПЕКИ

Abstract

Carrying out a comprehensive research of the understanding of expertise of social safety was possible through the disclosure of the main components of the factors, namely social safety and social expertise. The author gave his own definition of the understanding of social safety on the basis of the carried out scientific analysis of stable views of leading scientists in the field of jurisprudence, political science and sociology about the understanding of national safety and its component of social safety. Implementation of social safety on a personal level is possible at desire and participation in this process of the person himself, implementation of his aspirations to spiritual, cultural, material, educational, physical development, as well as at the voluntary assumption of responsibility for one's life. The basis on which such an approach should be based is the value of life of human, citizen, because when a person himself values his life, he can value the lives of other people, because without life, he has nothing and everything loses point. Characterizing the regulations that govern the conduction of expert activity in Ukraine, the author has determined that today there is inconsistency of acts of legislation that govern the activity of individual subjects of expert activity. In addition, the specified acts have different legal force. The specified circumstances lead to the impossibility of carrying out proper organization of expert support of justice at the state level and may cause an increasing of corruption risks in the relevant area of public administration. In addition, improper regulation of the mentioned legal relations will complicate carrying out state control in the relevant field of public administration in order to ensure the protection of existing and restoration of violated rights, freedoms and legitimate interests of human and citizen. The author's definition of expertise of social safety, the subject area of expertise of social safety and the main stages of its carrying out are provided in the conclusions of the scientific article. ; Проведення комплексного дослідження розуміння експертизи соціальної безпеки, було можливим завдяки роз- криттю основних складових чинників, а саме соціальної безпеки та соціальної експертизи. На основі проведеного наукового аналізу сталих поглядів провідних вчених в царині юриспруденції, політології та соціології на розуміння національної безпеки та її складової соціальної безпеки, автор подав власне визначення розуміння соціальної без- пеки. Реалізація соціальної безпеки на особистісному рівні можлива при бажанні та участі у цьому процесі самої особи, реалізації її прагнень до духовного, культурного, матеріального, освітнього, фізичного розвитку, а також добровільному взятті на себе відповідальності за своє життя. Основою, на якій має базуватися такий підхід, є цінність життя людини, громадянина, адже коли сама особа цінує своє життя, вона може цінувати життя інших людей, бо без життя нічого не має і все втрачає сенс. Охарактеризувавши нормативно-правові акти які регламентують провадження експертної діяльності в Укра- їні, автором було визначено, що на сьогодні спостерігається неузгодженість актів законодавства, що регулюють діяльність окремих суб'єктів експертної діяльності. Крім того, вказані акти мають різну юридичну силу. Зазначені обставини призводять до неможливості здійснення належної організації експертного забезпечення правосуддя на державному рівні та можуть зумовити зростання корупційних ризиків у відповідній сфері державного управління. Крім того, неналежне врегулювання згаданих правовідносин ускладнить здійснення державного контролю у відпо- відній сфері державного управління з метою забезпечення захисту існуючих та відновлення порушених прав, свобод і законних інтересів людини та громадянина. У висновках наукової статті подається авторське визначення екс- пертизи соціальної безпеки, предметна сфера експертизи соціальної безпеки та основні етапи її проведення.
