PUNISHMENTS ON THE UKRAINIAN LANDS UNDER CRIMINAL LEGISLATION OF AUSTRIA AND AUSTRO-HUNGARY (1772–1918) ; ПОКАРАННЯ НА УКРАЇНСЬКИХ ЗЕМЛЯХ ЗА КРИМІНАЛЬНИМ ЗАКОНОДАВСТВОМ АВСТРІЇ ТА АВСТРО-УГОРЩИНИ (1772–1918 рр.)

Abstract

The article concerns the characteristics of the origin and development of the institution of punishment on the Ukrainian lands as a part of Austria and Austro-Hyngary (1772-1918). Specific attention is paid to the analysis of criminal-legal norms concerning the aim and the system of punishments under the Austrian Criminal Codes of 1768, 1787, 1803, 1852. The author substantiates that the development of the institution of punishments under the Austrian criminal laws was aimed to the liberalisation of criminal punishments. ; У статті охарактеризовано становлення та розвиток інституту покарання на українських землях у складі Австрії та Австро-Угорщини (1772–1918 рр.). Значну увагу зосереджено на аналізі кримінально-правових норм про мету і систему покарання за австрійськими кримінальними кодексами 1768, 1787, 1803, 1852 рр. Обґрунтовано, що розвиток інституту покарання в австрійському кримінальному законодавстві був спрямований в бік лібералізації кримінальних покарань.
