Вікова неосудність як об'єкт наукового дослідження ; Mental retardation of minors as an object of scientific research

Abstract

У статті аналізується сучасний стан вивчення проблеми вікової неосудності, не пов'язаної з психічним розладом у людини. Здійснюється огляд теоретичних і експериментальних досліджень вітчизняних і зарубіжних науковців у сферах правознавства, психології, педагогіки і соціології. Використовуються матеріали судової практики, дані правової статистики і відповідний міжнародний досвід. Наводяться доводи на користь доцільності доповнення Кримінального кодексу України положенням про вікову неосудність неповнолітніх. Обґрунтовується теза, що за наявності у вітчизняному кримінальному законодавстві зазначеної новели неповнолітні із затримкою у психічному розвитку будуть захищені від можливості об'єктивного ставлення у вину. У статті підтримується пропозиція В. Бурдіна про те, що презумпція досягнення віку, з якого може наставати кримінальна відповідальність, мусить бути спростовною. ; The modern state of study of problem of age-dependent responsibility, unconnected with psychical disorder for a man is analysed in the article. The review of theoretical and experimental researches of domestic and foreign scientists is carried out in the spheres of jurisprudence, psychology, pedagogics and sociology. Materials of judicial practice, information of legal statistics and proper international experience, are used. Arguments are advanced in behalf on expedience of addition of the Criminal code of Ukraine by position about age-dependent diminished responsibility of minor. A thesis is grounded, that at presence of in the domestic criminal statute of the indicated short story minor time-lagged in psychical development will be protected from possibility of objective imputation. In the article suggestion of V. Burdina is supported that presumption of achievement of age which criminal responsibility can come from must be refutable. An author pays attention on contradiction of some positions of financial and judicial legislation of Ukraine in the aspect of confession of institute of age-old diminished responsibility of man. The signs of age-old diminished responsibility and medical criterion of diminished responsibility, fastened in the operating Criminal code of Ukraine are correlated in the article. Scientific approaches and directions are analysed in research of problems of age-old diminished responsibility of person.
