Abstract

В данной статье рассматривается вопрос, связанный, непосредственно, с участием прокурора в защите гражданских прав индивидуальных предпринимателей как участников арбитражного процесса при разрешении частноправового конфликта. Обращается внимание на некоторые проблемы путём сравнения категорий дел при участии прокурора в гражданском процессе с арбитражным процессом. Предложены некоторые рекомендации и доработки норм АПК РФ, которые в целом регулируют участие прокурора в арбитражном процессе, и в том числе направленные на совершенствование законодательства. ; This article deals with the issue, directly, with the participation of the prosecutor in the protection of civil rights of individual entrepreneurs, as participants in the arbitration process in the resolution of private law conflict. Attention is drawn to some problems, by comparing the categories of cases with the participation of the prosecutor in the civil process with the arbitration process. Some recommendations and refinements of the norms of the agrarian and industrial complex of the Russian Federation are proposed, which generally regulate the participation of the prosecutor in the arbitration process, including those aimed at improving the legislation.
