Bir kamu denetim sistemi olarak ombudsman ve Türkiye'de uygulanabilirliği ; The ombudsman as a public control system and its applicability in Turkey

Url: http://josc.selcuk.edu.tr/article/view/1075000236 ; Ombudsman, bir kamu denetim sistemi olarak ilk kez İsveç'te uygulanmaya başlamış, daha sonra tüm dünya geneline yayılmıştır. Dünyanın birçok ülkesinde -her ülkenin kendi yapısı doğrultusunda- yaygın olmakla beraber, ombudsmanı henüz uygulamayan ülkeler de mevcuttur. Bu çalışma, söz konusu ülkelerden biri olan Türkiye'de, bir kamu denetim sistemi olarak ombudsmanın uygulanabilirliğini ortaya koymayı amaçlamaktadır. Öncelikle ombudsmanla ilgili genel bilgilere yer verilmiş, daha sonra konu ile ilgili Türkiye'deki mevcut durum tespit edilmiştir. Metinde, ombudsmanın tarihsel gelişim süreci, ulusal ve uluslararası literatürdeki tanımları, yetkisi, statüsü, görevleri ve işlevleri anlatılmış; daha sonra da bu bilgilere dayanarak Türkiye'de ombudsmanın uygulanabilirliği dört boyutta ele alınmıştır. Öncelikle ombudsmanı Türkiye için gerekli kılan sebepler; daha sonra da uygulamanın ardından karşılaşılacak zorluklar ve ülkeye sağlaması beklenen yararlar üzerinde durulmuştur. Son olarak da, başarılı bir uygulama için sistemin hangi biçimde yapılanması gerektiği sorusu cevaplanmaya çalışılmıştır. Çalışmanın sonucu olarak, hemen hemen tüm kamu kurumları için gerekli olan ombudsmanın (karşılaşacağı sorunlar ve mevcut yönetim yapısı dikkate alınıp, kendi öz niteliklerine tamamen uygun bir şekilde yapılandırılması halinde), birçok açıdan Türkiye'ye de yararlı olacağı ortaya çıkmaktadır. ; The Ombudsman as a public control system was first practiced in Sweden, and then became widespread throughout the world. Although it is popular in many countries of the world - in a tailored manner to each country's own structure-, there are still other countries that haven't put the ombudsman into practice. This study aims to show the feasibility of the ombudsman as a public control system in Turkey, one of these countries. General information on the ombudsman has been given in the beginning and then current conditions in Turkey have been described. In the text, the historical development process of the ombudsman has been described, together with its definitions in the Turkish and international literature, its authority, status and functions, then based on those information, its applicability in Turkey has been discussed in four dimensions. Firstly, the reasons which make the ombudsman a necessity for Turkey have been taken into account, followed by the difficulties which may arise after its implementation, as well as its expected benefits to the country. Lastly the question of which form the system should be structured in for a successful operation has been discussed. The study concludes that the Ombudsman which is necessary for almost every public organization, would be useful for Turkey from many aspects, if the potential problems and the present administrational infrastructure of the country are carefully considered, and it is structured in complete accordance with its own essence and virtues.
