Normativa de drones (RPAS) civiles en España : análisis de su creación y evolución

Abstract

Este trabajo muestra cómo se producido la regulación de drones civiles a nivel nacional, a fin de averiguar si a día de hoy la legislación vigente es completa y definitiva, o si, por el contrario, es inconclusa o presenta determinadas carencias. En este sentido se examina la necesidad de regulación, tanto en su vertiente positiva, como negativa, así como se analizan las respectivas contextualizaciones del sector, mostrando paulatinamente el avance del mismo, a fin de revelar su situación real. Tras unos inicios de regulación esencialmente restrictiva que derivó en un malestar general, entró en vigor el actual Real Decreto 1036/2017, por el que se ampliaron los horizontes del sector. Sin embargo, asimismo, presenta determinadas carencias, tanto teóricas, como prácticas, a causa de las cuales los usuarios no ven satisfechas sus demandas, a tenor de lo que podría parecer en un principio. Además, aún promulgarse como una regulación definitiva, cierto es que, paralelamente, se ha desarrollado un marco normativo común a nivel europeo, contenido en el Reglamento (UE) 2018/1139, con eficacia progresiva prevista a partir del 1 de julio de 2020, que pretende ser más coherente y completo. No obstante, esta investigación muestra que se incrementarán considerablemente las aplicaciones en un futuro, principal motivo por el cual la legislación tendrá que ir avanzando a medida que lo haga la tecnología, así como la necesaria aceptación popular. ; This work shows how the regulation of civil drones took place at the national level, in order to find out if nowadays the current legislation is complete and finished or, on the other hand, if it is inconclusive or it presents certain deficiencies. In this sense, the need for regulation is examined, in both positive and negative aspects, as well as the respective contextualisations of the sector are analyzed, gradually showing its progress, in order to reveal its real situation. After the beginnings of essentially restrictive regulation that led to general unrest, the current Royal Decree 1036/2017 entered into force, which broadened the horizons of the sector. However, it also presents certain deficiencies, both theoretical and practical, as a result of which users do not see their demands satisfied, based on what it might seem at first. In addition, even being enacted as a definitive regulation, it is true that, in parallel, a common regulatory framework has been developed at the European level, contained in Regulation (EU) 2018/1139, with progressive effectiveness foreseen from July 1, 2020, which aims to be more coherent and complete. Notwithstanding, this investigation shows that the applications will considerably increase in the future, the main reason why legislation will have to advance as technology does, as well as the necessary popular acceptance.
