La situación de los derechos humanos tras la primavera árabe ; Human right's situation after the arab spring

Abstract

Las tres principales demandas de la Primavera Árabe fueron "libertad, justicia y dignidad". La universalidad de los derechos humanos ha sido tradicionalmente cuestionada en el mundo árabe tanto por los regímenes autoritarios nacionalistas como por los gobiernos conservadores. Los primeros interpretaban que dichos derechos deberían restringirse cuando representaran una amenaza para su perduración en el poder, mientras que los segundos recurrieron al relativismo cultural al considerar que chocaban contra la sharía islámica. Aunque en teoría las Constituciones árabes preservaban los derechos civiles, políticos, económicos y sociales, lo cierto es que en la práctica fueron restringidos por las leyes de emergencia. Tras la Primavera Árabe se generaron unas expectativas desmesuradas en la democratización del mundo árabe, pero pronto se evidenció que los nuevos gobiernos salidos de las urnas no tenían entre sus prioridades la defensa de los derechos humanos. En términos generales, podemos decir que la situación de los derechos humanos no sólo no ha mejorado, sino que se ha deteriorado de manera sustancial en el Magreb y Oriente Medio ; The three main demands of the Arab Spring were "freedom, justice and dignity". The universality of human rights has traditionally been questioned in the Arab World both by authoritarian nationalist regimes and by the conservative governments. The former interpreted that such rights should be restricted when they represented a threat to their power, while the latter resorted to cultural relativism on the grounds that they clashed with Islamic sharia. While in theory the Arab Constitutions preserved civil, political, economic, social and cultural rights, in reality these rights were usually restricted by emergency laws. The Arab Spring generated expectations in the democratization of the Arab world, but it soon became clear that the new governments did not have among their priorities the defence of the human rights. In general terms, we can say that the situation of human rights has not only not improved, but has deteriorated substantially in North Africa and the Middle East
