Abstract

The LMPs of the municipalities must accept determinants that constitute rules of higher hierarchy within their own spheres of competence. The materialization of normative contents of higher hierarchy requires hiring, an activity beset by problems that hinder and divert the realization of those contents that are inserted in the LMPs. From the question: Which problems make possible a public policy for the planning of state contracting in a way that contributes with the proper realization of the legal determinants of higher hierarchy from which policies planned on the Colombian LMPs are underpinned? The initial components were determined for the formulation and design of a public policy for the planning of Government contracting that ensures the accomplishment of the purposes of the State regulated from the determinants of higher hierarchy. The research employed a design based on the qualitative methodology supported by the historical hermeneutical approach and focused on documentary research. As public problems the indeterminate status of the principle of planning, the neglect of Law 80 of 1993 to economic theory, the incompleteness of the state contract and their obligatory renegotiation; the risks, the theory of unpredictability, the contractual equation and the economic equilibrium in contracts, and the exclusion of state entities. ; Los POT de los municipios deben acoger determinantes que se constituyen en normas de superior jerarquía en sus propios ámbitos de competencia.
