Bogus self-employment and bogus internships: an institutional approach to the Spanish case ; Falsos autónomos y falsos becarios: una aproximación institucional al caso español

Abstract

The article aims to contribute to the debate on irregular employment in Spain, by addressingbogus self-employment and bogus internships forms. Drawing from an institutional approach, it analyses the influence that three fields have on these labour frauds, derived from managerial approaches aiming to obtain competitive advantageous: two state fields associated to the regulation and the enforcement of the regulation, articulated through the Labour and Social Security Inspectorate (ITSS); and the industrial relations field which, in Spain, strongly depends on the state and the legislation. The article confirms the relevance of the three institutional fields studied, the interaction and interrelation of which contributes to understand the existence of both fraudulent practices. At the same time, elements and initiatives are identified that suggest that, within the existing institutional framework, there is roomto contribute to reduce its diffusion. ; El artículo pretende contribuir al debate sobre el empleo irregular en España, a través del análisis de las figuras del falso autónomo y el falso becario. Partiendo de una perspectiva institucional, se estudia la influencia que, sobre estos fraudes laborales, derivados de estrategias empresariales encaminadas a obtener ventajas competitivas, ejercen tres campos: dos estatales asociados, por una parte, al área de la regulación y, por otra, al control del cumplimiento de dicha regulación, concretado en la Inspección de Trabajo y Seguridad Social (ITSS); y un tercero, el de las relaciones laborales, que, en el caso español, depende de manera considerable del estado y la legislación. Para ello se recurre, metodológicamente, a una revisión de la bibliografía y normativa más relevante, y un trabajo de campo basado en entrevistas semi-estructuradas a agentes sociales e inspectores de trabajo y seguridad social. El artículo confirma la relevancia de los tres campos institucionales estudiados, cuya interacción conjunta e interrelacionada contribuye a entender la existencia de estas prácticas. Se identifican también elementos e iniciativas que sugieren que, dentro el marco institucional actual, existe espacio para contribuir a reducir su difusión.
