Los animales como parte de la naturaleza: ¿objetos o sujetos de derechos?

35 páginas ; En este capítulo se presenta la evolución y el estatus del reconocimiento de derechos a la naturaleza y a los animales bajo el enfoque biocentrista que han adoptado las constituciones en Latinoamérica, entre ellas la de la Ciudad de México promulgada en 2018 bajo un proceso constituyente participativo. Se analiza la confrontación con la normativa, especialmente del derecho civil, que considera como objetos de apropiación a los animales y a la naturaleza, y el tránsito hacia este nuevo enfoque que es trasladado a las constituciones locales del país (no la nacional), para dotarlas de mayor protección en torno a la idea de bienestar animal, trato digno y humanitario o su consideración como sujetos de derechos. Concretamente se aborda la legislación mexicana federal y de las entidades federativas, así como los efectos de las resoluciones administrativas ante denuncias de maltrato animal, a la luz de la evolución del enfoque biocentrista en Latinoamérica. ; The evolution and status of the recognition of animal and nature rights are presented under a biocentric approach that the constitutions in Latin America have adopted; among them, the Constitution of Mexico City adopted in 2018 under a participatory constitutional process. The confrontation with the regulations is analized, especially the civil law that considers animals and nature as an object of appropriation; and the transition to this new approach that is transferred to the country's local constitutions (not the national one). This provide them with greater protection around the idea of animal welfare, dignified and humanitarian treatment of their consideration as subjects of rights. Specifically, we review the Mexican federal and the state´s legislation, as well as the effects of administrative rulings on complaints of animal abuse, in light of the evolution in Latin America of the biocentric approach.
