Abstract

The article aims at clarifying the issues related to the usage in legal acts of partly formally defined (i.e. semi-estimative or intermediate between the formally defined and formally undefined) concepts. The way of understanding of the content of half-estimative concepts is proposed, their features and properties are highlighted. The key reason for introducing such concepts into the texts of the designed legal acts are identified. Attention is drawn to the specific aspects of interpretation of legal norms that include half-estimated concepts. ; Стаття присвячена з'ясуванню особливостей використання у нормативно-правових актах частково формально визначених (напівоціночних, проміжних між формально визначеними і формально невизначеними) понять. Запропоновано розуміння змісту напівоціночного поняття, виокремлено його ознаки та властивості. Встановлено ключові підстави для введення таких понять у тексти проектованих нормативно-правових актів. Звернуто увагу на специфічні аспекти тлумачення юридичних норм із такими поняттями.
