Derecho Tributario y teorías de la justicia: una visión desde la propuesta aristotélica y las teorías contemporáneas de la justicia de Rawls y Dworkin

Abstract

La desigualdad en el ingreso y la persistencia de altos grados de pobreza en gran parte de la población del mundo hacen relevante la pregunta por la justicia en relación con la función redistributiva del Estado. Esta es una de las razones importantes por las que los Estados han recurrido al aumento del cobro de impuestos como forma privilegiada de la obtención de recursos para lograr sus tareas sociales. El derecho tributario se ha convertido, de esta manera, en un eje de reflexión que interesa también a la crítica filosófica. En este horizonte problemático la pregunta central de este artículo de investigación será: ¿Qué aportes se han realizado desde las teorías de la justicia distributiva a la política tributaria de los últimos años, a la luz de la teoría aristotélica sobre justicia distributiva y de las concepciones en torno a los tributos en el marco de las teorías contemporáneas de la justicia de J. Rawls y R. Dworkin? ; Inequality in income and the persistence of high levels of poverty in a large part of the world's population make the question of justice relevant to the redistributive role of the State. This is one of the important reasons why States have resorted to increased tax collection as a privileged way of obtaining resources to realize their social tasks. Tax law has thus become an axis of reflection that also interests the philosophical review. In this problematic horizon the central question of this research article will be: Which contributions have been made from the distributive justice theories to the tax policy of the last years, in the light of the Aristotelian theory on distributive justice and the conceptions around the tributes within the framework of contemporary justice theories of J. Rawls and R. Dworkin?
