Abstract

EL CONSEJO ACADEMICO DE LA UNIVERSIDAD AUTÓNOMA DE BUCARAMANGA – UNAB En uso de sus atribuciones estatutarias y reglamentarias y, CONSIDERANDO: 1. Que mediante Resolución 024 de 5 de mayo de 2005, del Consejo Académico, modificada por la Resolución No. 317 de Noviembre 21 de 2007, en el ejercicio de la autonomía universitaria establecida en la Carta Política, se estableció como uno de los requisitos institucionales de grado para las carreras profesionales existentes en la universidad la acreditación de la presentación del Examen de Estado de la Calidad de la Educación Superior ECAES. 2. Que la norma reglamentaria de los ECAES contemplada en la Ley 749 de 2002 fue declarada INEXEQUIBLE por la Corte Constitucional, mediante Sentencia C-782_07 de 26 de Septiembre de 2007, sentencia modulada que adicionalmente señaló la obligación del Congreso de la República de expedir la ley reglamentaria de dichos exámenes, señalando un término hasta el 17 de diciembre de 2009. 3. Que hasta la fecha el Congreso de la República no ha dictado la ley en cuestión, por lo que el Estado no puede en este momento convocar a los estudiantes a la presentación de dicha prueba ni menos practicarla, por lo cual los estudiantes de la UNAB no pueden satisfacer el requisito exigido por su ordenamiento interno. 4. Que en virtud de lo anterior y en aras de facilitar la culminación del proceso formativo de los estudiantes ante la imposibilidad actual de obtención del requisito ya señalado, se hace necesario suspender las Resoluciones No. 024 de Mayo 5 de 2005 del Consejo Académico y Resolución No. 317 de Noviembre 21 de 2007 de Rectoría, ; ARTÍCULO PRIMERO ARTÍCULO SEGUNDO ARTÍCULO TERCERO ; THE ACADEMIC COUNCIL OF THE AUTONOMOUS UNIVERSITY OF BUCARAMANGA - UNAB In use of its statutory and regulatory powers and, CONSIDERING: 1. That through Resolution 024 of May 5, 2005, of the Academic Council, modified by Resolution No. 317 of November 21, 2007, in the exercise of the university autonomy established in the Political Charter, it was established as one of the requirements institutional degrees for existing professional careers at the university accreditation of the presentation of the State Examination of the Quality of Higher Education ECAES. 2. That the regulatory norm of the ECAES contemplated in Law 749 of 2002 was declared INEXEQUIBLE by the Constitutional Court, through Sentence C-782_07 of September 26, 2007, a modulated judgment that additionally indicated the obligation of the Congress of the Republic to issue the regulatory law of said examinations, indicating a term until December 17, 2009. 3. That to date the Congress of the Republic has not enacted the law in question, so the State cannot at this time summon students to the presentation of said test, let alone practice it, for which reason the students of the UNAB cannot satisfy the requirement demanded by its internal regulations. 4. That by virtue of the foregoing and in order to facilitate the completion of the training process for students in the face of the current impossibility of obtaining the aforementioned requirement, it is necessary to suspend Resolutions No. 024 of May 5, 2005 of the Academic Council and Rectory Resolution No. 317 of November 21, 2007
