Laïcité 1996. ; : La République à l'école de l'immigration ?

Abstract

International audience ; The idea of 'laicité' is inscribed in history, one cannot define its meaning in absolute terms. Today as well as earlier, its political value is polarized between a liberal meaning and an anti-liberal one said to be 'republican'. Nevertheless, three features seem to be specific to the 1990s: - the discrepancy between the dominant political acceptation of 'laicité' and its juridical sense, flowing from the Constitution and framed by international law; - the national connotation of the debate, pointing at immigrant residents from the Muslim word and suspecting that they do not truly belong to the nation; - and lastly the connection of this debate with the longstanding debate about changing public education to a more modern form which would imply both constructivist epistemology and liberal 'laic' ethics. All these are at stake in the current 'veil affairs' ; L'idée de laïcité n'est pas soustraite à l'histoire. C'est pourquoi il est illusoire de postuler son sens dans l'absolu. Aujourd'hui, comme en d'autres époques, sa valeur politique tend à se polariser sur une opposition binaire entre une acception libérale et une acception anti-libérale dite républicaine. Toutefois, trois traits semblent particuliers aux années 1990: - la disjonction entre l'acception politique dominante de la laïcité et sa force juridique, gagée par la Constitution et cadrée par des instruments juridiques internationaux ; - l'orientation nationalitaire du débat, pointant vers les populations issues de l'immigration musulmane, et questionnant leur appartenance à la nation ; - enfin, l'inscription du débat dans la problématique globale de la modernisation des formes scolaires, laquelle véhicule à la fois une épistémologie constructiviste et interactionniste, et une éthique laïque libérale. Les "affaires de foulards" sont un analyseur de cette complexité.
