QU'EST-CE QUE LE CONTRÔLE IN CONCRETO ?

Abstract

International audience ; To confuse it with the exclusion of a legislative prohibition without creating criteria for intepreting the rule in futures cases is to ignore what is to review the law in concreto. It is revealing, under this confusion, another confusion bringing into opposition between reasoning with rules and reasoning by case, whereas in concreto review, like control in abstracto too, which do not oppose as much as their denomination suggests, are in the construction of the rule and the case, two things closely intertwined in law.
