Abstract

El autor considera que la tesis defendida en el trabajo de J. M. Vilajosana, Democracia y derecho a decidir es insostenible: el derecho a decidir (o sea, el derecho a la secesión) es incompatible con el Derecho español actual. Entre muchos otros defectos, la tesis de Vilajosana presupone una concepción del Derecho y de la interpretación en la que el texto de las normas (concretamente el de las normas constitucionales) resulta completamente irrelevante. ; The author considers that the thesis defended in the work of J. M. Vilajosana, Democracia y derecho a decidir, is untenable: the right to decide (that is, the right to secession) is incompatible with current Spanish law. Among many other defects, Vilajosana's thesis presupposes a conception of law and interpretation in which the text of the norms (specifically that of the constitutional norms) is completely irrelevant.
