Abstract

En el acuerdo final pactado entre el Estado colombiano y las FARC-EP se establecieron unas medidas que son necesarias para satisfacer los derechos de las víctimas; dentro de estas se acordó la creación de la Jurisdicción Especial para la Paz (JEP) como una fórmula de justicia novedosa para facilitar el proceso de reconciliación política, mientras se garantiza la asunción de responsabilidades con apego a los estándares internacionales. No obstante, en medio de una álgida disputa política, no se ha valorado, en sus reales dimensiones, la importancia de dicha propuesta para el proceso de superación del conflicto armado. El presente texto analiza, con herramientas de la teoría del derecho y del derecho internacional, los derechos humanos y los elementos del acuerdo sobre la jep, para, a partir de allí, reflexionar sobre la importancia de su implementación. ; In the final agreement between the Colombian State and the FARC-EP, a series of measures were established that are necessary to satisfy the rights of the victims: within these measures, the creation of the Special Jurisdiction for Peace was agreed, as a novel justice formula to facilitate the process of political reconciliation, while guaranteeing the assumption of responsibilities in accordance with international standards.
