Abstract

El reconocimiento de garantías a grupos de especial protección ha incidido en la construcción jurídica de una categoría especial de sujetos, sobre las que busca reflexionar este artículo. El propósito es evidenciar cómo el reconocimiento de los "sujetos de especial protección" ha tomado relevancia con la Constitución Política de 1991 y su interpretación por la Corte Constitucional. Desde un enfoque descriptivo e interpretativo, en el ámbito internacional se ha avanzado de la protección de minorías étnicas al reconocimiento específico de otros sujetos, incidiendo en el sistema colombiano, que reconoce grupos de especial protección bien por "condiciones de debilidad manifiesta" o bien por la posición de 'indefensión'. La jurisprudencia ha representado el mayor avance, por lo que al Estado le corresponderá avanzar en acciones afirmativas efectivas para la protección y garantía especial de estos sujetos y sus derechos, en aplicación del principio/derecho a la igualdad de oportunidades y la no discriminación. ; This article seeks to reflect on the recognition of guarantees to groups of special protection that has had an impact on the legal construction of a special category of subjects. The purpose is to show how the recognition of those "subjects of special constitutional protection" has taken relevance with the Political Constitution of 1991 and its interpretation by the Constitutional Court. From a descriptive and interpretative approach at the international level, advances have been made from the protection of ethnic minorities to the specific recognition of other subjects, which is influencing the Colombian legal system that recognizes groups of special protection either for "conditions of manifest weakness" or for the position of 'helplessness'. Jurisprudence has represented the greatest advance so the State will be responsible for the affirmative actions for the protection and special guarantee of these subjects and their rights in application of the principle/right to equal opportunities and non-discrimination.
