Abstract

Los derechos fundamentales son investigados por Niklas Luhmann a partir de su función en relación con cl sistema jurídico, así como en relación con el sistema social en su conjunto. Su función radica en la aseguración del nexo y de la diferenciación comunicativa entre sistema político y sistema jurídico, que refleja la que existe entre sistema político y sociedad. El sistema político evita, a través de los derechos fundamentales, extender su esfera de competencia a las diferentes esferas de la comunicación pública, al liberar de su potencial dominio fenómenos sociales ajenos a él, y al consolidar la estructura burocrática estatal. Los derechos humanos constituyen un momento crucial en la teoría de Luhmann dado que, al insertar una fuente de legitimación normativa externa al sistema jurídico, identificada en el escándalo generado en la opinión pública por la vulneración de los derechos humanos, expone el sistema jurídico al riesgo de pérdida de su especificidad funcional. ; Fundamental rights are investigated by Niklas Luhmann from the point of view of their function with respect to the legal system as well as to the overall social system. Their function is to ensure the nexus and communicative differentiation between the political and legal systems, which mirrors the one between the political system and the society. Through fundamental rights, the political system avoids to extend its sphere of competence to the different spheres of public communication, excluding from its potential domination social phenomena that do not belong to it and consolidating the State bureaucratic structure. Human rights play a crucial role in Luhmann's theory insofar as, by including a source of legal legitimacy external to the legal system, consisting in the scandal generated in public opinion by the violation of human rights, they expose the legal system to the potential loss of its functional specificity.
