La progresiva ampliación del ámbito típico del delito de corrupción privada ; The progressive extension of the scope of the crime of private corruption. ; Die allmähliche Erweiterung der Strafbarkeit der privaten Korruption

Abstract

Se analiza el nuevo delito de corrupción privada en el ámbito de los negocios -tras su modificación por LO 1/2015 y LO 1/2019-, consistente en el pago de sobornos para obtener ventajas competitivas en el sector privado (art. 286 bis). La LO 1/2015, entre otras cuestiones de menor calado, elimina la exigencia del "incumplimiento de las obligaciones" en la relación comercial objeto de soborno, lo que parece indicar que el Legislador ha optado por incriminar un modelo puro de competencia desleal. La LO 1/2019 cumpliendo con las Directrices del Grupo de Estados Contra la Corrupción (GRECO), adelanta la barrera punitiva de la conducta típica en el cohecho pasivo de este delito subsanando la disfunción que existía con la modalidad de corrupción activa, en coherencia con la tipificación del cohecho pasivo de ámbito público. ; I analyze the new offense of private corruption in business after the reform of the Criminal Code -operated by the Organic Law 1/2015 and the Organic Law 1/2019-, consisting of the payment of bribes to obtain competitive advantages in the private sector (art. 286 bis). The Organic Law LO 1/2015, among other issues of lesser importance, eliminates the requirement of "breach of duty" in the commercial relationship subject to bribery, which seems to indicate that the legislator has chosen to incriminate a pure model of unfair competition. LO 1/2019 complies with the Guidelines of the Group of States against Corruption (GRECO), advances the punitive barrier of the typical behavior in the passive bribery of this crime, correcting the dysfunction that exists with the active bribery modality, according with the passive bribery of public sphere. ; In dem vorliegenden Beitrag wird die neue spanische Straftat der privaten im geschäftlichen Verkehr – nach seiner Novellierung durch die Gesetze LO 1/2015 und LO 1/2019 –, die die Fälle der Zahlung von Bestechungsgeldern, um Wettbewerbsvorteile zu erlangen, umfasst.
