Las voces de la ley : Aportes para pensar la Ley de Identidad de Género ; Voices of the law. Contributions to think on the Gender Identity Law

Abstract

El presente trabajo se inscribe en la investigación doctoral denominada Modos de relacionalidad y construcción de vínculos significativos en sujetos que integran colectivos socio sexuales disidentes y tiene como objetivo analizar la legislación vigente respecto a los derechos relacionados con la diversidad sexual, específicamente la Ley 26743 de Identidad de Género. Mediante una revisión bibliográfica se indagan los cambios que en materia de normativas y categorías tradicionales sobre la sexualidad se han producido entre la segunda mitad del siglo XX y los comienzos del siglo XXI, cambios que resultan los antecedentes de la Ley de Identidad de Género. El devenir de estas transformaciones nos lleva a pensar el papel que, en términos políticos, tuvo el activismo de los grupos de diversidad sexual. En este punto, coincidimos con Paula Viturro (2014) en considerarlo como una experiencia calificada, emancipatoria, democrática y política, en los términos de Jacques Ranciére. ; This work is part of the doctoral research called Modes of relationality and construction of significant bonds in individuals that integrate dissident socio-sexual groups and aims to analyze the current legislation regarding rights related to sexual diversity, specifically Law 26743 of Gender Identity. By means of a bibliographical revision, we investigate the changes that in the matter of norms and traditional categories have occurred between the second half of the twentieth century and the beginning of the twenty-first century, these changes became the background of the Gender Identity Law. The evolution of these transformations leads us to think about the role that, in political terms, the activism of sexual diversity groups have had. At this point, we agree with Paula Virruto (2014), in considering it as a qualified experience that is emancipatory, democratic and political, in terms of Jacques Ranciére. ; Facultad de Psicología
