Abstract

El concepto de "agresión" ha sido central para el Derecho Internacional al momento de legislar y poner en marcha instituciones vinculadas al mantenimiento de la paz y seguridad internacionales, así como la arquitectura de la Seguridad Colectiva. Al momento de reglamentar la ley de Defensa Nacional 23.554, el Decreto Reglamentario 727/06 trasladó el concepto de "agresión" que fue adoptado en el ámbito de Naciones Unidas, sin tener en cuenta los complementos con los cuales dicho concepto se convierte en un todo en el contexto de dicha organización. El nuevo Decreto Reglamentario 683/18 remedia dicho problema, aunque no sin polémica. En éste artículo, abordaremos el origen y desarrollo del concepto de "agresión" del Derecho Internacional general, su utilización en el derecho doméstico, destacaremos las limitaciones del mismo y señalaremos los aspectos sobre los cuales se han producido los cambios con el decreto reglamentario 683/18, modificatorio del 727/06. ; The concept of aggression is very important in International Law as it was considered a key notion when legislating and working on institutions linked to the maintenance of international peace and security, as well as to Collective Security Architecture. When National Defense Law No 23554 was regulated, Decree No 727/06 borrowed the concept of aggression adopted by the United Nations and transferred it without taking into consideration the complements with which the concept becomes a unit in the context of such organization. Albeit controversially, the new decree (683/18) solved that problem.
