Ética al principio de la vida ; Ethics at the beginning oflife

Abstract

Teniendo en cuenta que los importantes desarrollos tecnológicos y científicos en materia de salud han impactado en las realidades cotidianas y valores de cada sociedad, el desafío para la ciencia jurídica consiste en detectar esos nuevos valores éticos introducidos por los adelantos biotecnológicos, a fin de enfrentar y dar respuestas a las nuevas realidades sociales, obligando a una constante reelaboración jurídica y, consecuentemente, normativa. Ello así y considerando la importante interrelación entre la bioética, el derecho de familia y el rol de la familia en la composición del tejido social, el eje central del presente trabajo busca observar las distintas consideraciones bioéticas respecto del comienzo de la existencia de la persona humana en función de las nuevas técnicas de reproducción humana asistida, y la naturaleza jurídica adjudicada a los embriones criopreser- vados, en consonancia con la legislación nacional y la jurisprudencia nacional e internacional. ; Bearing in mind that important technological and scientific develop- ments in health have impacted on the daily realities and valúes of each society, the challenge for legal science is to detect those new ethical values introduced by biotech- nological advances, in order to face and respond to the new social realities, forcing a constant legal and consequently normative reelaboration. This way and considering the important interrelation between bioethics, family law and the role of the family in the composition of the social fabric, the central axis of the present work seeks to observe the different bioethical considerations, regarding the beginning of the exis- tence of the human person in function of the new techniques of assisted human re- production; and the legal nature assigned to cryopreserved embryos, in accordance with national legislation and national and international jurisprudence. ; Facultad de Ciencias Jurídicas y Sociales
