La investigación jurídica, su necesidad y su impacto

Abstract

Law exists being inextricably linked to politics and economics. In the same way as these, it can be known and investigated in two of its dimensions: a. as a social practice b. as theory. As a practice or social fact, law manifests itself in the form of a system of mandatory rules, values and principles, which governs social relations. A particular feature is its coercivity, guaranteed by legal political institutions (the police, judges, prisons, the constitution and laws). Interdependence of the Law and the emergence, development and functioning of the State, constitutes a fundamental characteristic of the social organization of the state. Law cannot exist without the State that produces or guarantees legal rules and ensures its compliance, by applying the corresponding penalties for violators of the rules if necessary. ; El derecho lo mismo que la política y la economía a las cuales está unido indisolublemente, existe y puede investigarse, conocerse en una doble dimensión: a. como práctica social b. como teoría. Como práctica o hecho o social, el derecho se manifiesta en forma de un sistema de normas obligatorias, valores y principios, que regula las relaciones sociales. Una característica particular es su coercitividad, garantizada por las instituciones político jurídicas (la fuerza pública, los jueces, las cárceles, la constitución política y las leyes). La interdependencia del derecho y del Estado en su surgimiento, desarrollo y funcionamiento, constituye una característica fundamental de la organización social estatal. El derecho no puede existir sin el Estado, que produce o avala las normas jurídicas y vela por su cumplimiento, aplicando en caso necesario las sanciones correspondientes a los infractores de las normas.
