ESSERE SCHIAVI IN ETÀ GIULIO-CLAUDIA TRA DIRITTO E SOCIETÀ: ALCUNE NOTAZIONI

Abstract

Per tutto l'evo antico la 'classe' servile fu, per definizione, quella maggiormente esposta ad una violenza quotidiana in forme istituzionalmente codificate (basti pensare al trattamento durissimo riservato in ogni epoca della storia di Roma agli schiavi fuggitivi) e accettate da tutte le categorie parte integrante di una società già di suo fortemente sperequata. Il contributo si propone di indagare in che misura i provvedimenti normativi riconducibili agli imperatori della prima dinastia – e che le fonti interpretano come atti di humanitas nei confronti della popolazione servile – abbiano effettivamente concorso, se non a modificare l'ideologia della violenza sugli schiavi, quanto meno a mitigarla, tenendo nel dovuto conto la differenza tra schiavitù domestica urbana e schiavitù rurale in termini di strumenti coercitivi – fisici e psicologici – usati dai padroni sulla componente servile entro i suddetti quadri sociali. Throughout the ancient age the slavish 'class' was, by definition, the most exposed to a quotidian violence in a variety of institutionally coded forms (it is the case of the very harsh treatment reserved to fugitivi in all periods of Roman history) and consequently accepted by all categories which are integral part of a society already strongly unequal. This contribution aims to investigate the measure in which the legislative provisions that could be attributed to Emperors of the first dynasty and interpreted from the sources as acts displaying a kind of humanitas towards the slavish population had effectively contributed, if not to modify the ideology of violence on slaves, a least to seek of mitigate it, taking due account of the difference between domestic urban and rural slavery in terms of coercive instruments – physical as well as psychological – used by the masters on the slavish component of the above social communities.
