52 páginas. ; Durante el segundo semestre de 2016 se firmaron los Acuerdos de Paz de La Habana entre el Gobierno de Colombia y las Fuerzas Armadas Revolucionarias de Colombia (FARC) con el objetivo de terminar el conflicto armado que azotó al país durante más de cincuenta años, tiempo en el cual se cometieron crímenes de lesa humanidad; mediante el Acto Legislativo 01 de abril de 2017 el Congreso establece que se debe castigar a los culpables, sin embargo en una contienda con un desarrollo tan complicado es difícil establecer quiénes cometieron estos delitos y, aún más, determinar quiénes dieron las órdenes de su cumplimiento y bajo qué condiciones. El presente artículo pretende definir y determinar la aplicabilidad y viabilidad de los términos "responsabilidad por mando" y "control efectivo" para los agentes del Estado, aportando al tema en el marco de una sustentación jurídica, mediante la investigación de los antecedentes legales (Estatuto de Roma, Convenios de La Haya) e históricos (Ex-Yugoslavia, Ruanda) de estas expresiones, y su pertinencia y validez dentro de la Jurisdicción Especial para la Paz (JEP). ; During the second semester of 2016, the Havana Peace Agreements between the Government of Colombia and the Revolutionary Armed Forces of Colombia (FARC) were signed with the aim of ending the armed conflict that hit the country for more than fifty years, time that the which crimes against humanity were committed; Through the Legislative Act April 1, 2017 the Congress states that the guilty parties must be punished, in contention with such a complicated development it's too difficult to establish who committed these crimes and, even more, to determine who gave the orders of compliance and under what conditions. This article aims to define and determine the applicability and viability of the terms "responsibility by command" and "effective control" for State agents, contributing to the subject within the framework of legal support, through the investigation of legal background (Statute of Rome, The Hague Conventions) and historical (Ex-Yugoslavia, Rwanda) of these expressions, and their relevance and validity within the Special Jurisdiction for Peace (JEP).
