La justicia militar y los milicianos durante la primera década revolucionaria en la campaña de Buenos Aires (1810-1820)

Abstract

En este trabajo, se examina la aplicación de la Justicia militar a los milicianos de la campaña bonaerense, desde la revolución hasta la abolición del fuero militar en 1823. Para ello, se han relevado los sumarios militares levantados contra milicianos. Se analizan los delitos, las formas que toma el proceso y el grado de apego a la legislación vigente. En los sumarios, puede observarse la escasa influencia de las leyes indianas, el uso del arbitrio judicial favorable a los acusados y la menor preocupación por los crímenes de los subalternos, por lo que los milicianos gozaban de una mejor posición frente a esta institución que sus pares veteranos. ; In this paper, the military justice applied to militiamen from the countryside of Buenos Aires are analyzed between the revolution and the abolition of military jurisdiction in 1823. The research will be based on military summaries which have been reviewed. It will be analyzed the felonies, the characteristics of the judicial process and the grade of attachment to the current legislation. Furthermore, it's also possible to observe the limited influence of the indian legislation, the judicial discretion favorable to the defendants and the least preoccupation of the military justice to the subordinate's crimes. This situation placed the militiamen on a better position than their veteran partners facing to that institution.
