El paradigma de la seguridad y las tensiones con los derechos humanos. / The Paradigm of Security and Tensions with Human Rights

Abstract

RESUMEN Desde la última década del siglo XX los temas relacionados con la seguridad se han convertido en un referente del accionar político, social y jurídico. El texto tiene como objetivo, analizar el concepto de la seguridad en el contexto social-político y la respuesta frente a este modelo desde el discurso de los derechos humanos. Abordamos el estudio desde una perspectiva sociojurídica, con un enfoque cualitativo, en el cual se utilizaron referentes bibliográficos provenientes de la teoría social. El principal hallazgo consistió en evidenciar como las políticas basadas en la seguridad están en contravía del modelo garantista propio del Estado social de derecho.ABSTRACT Since the last decade of the twentieth century, issues related to security have become an important aspect of political, social and legal decision-making. The aim of the text is to analyze the concept of security in the socialpolitical context and its impact on punishment as a form of social control. We approached the study from a socio-legal approach, with a qualitative approach, in which bibliographic references from social theory were used. The main finding was to show how security-based policies are not based on a guarantee model of the social state of law.
