Legislative Support for the Protection of Cultural Heritage in the Historical Settlements of Ukraine

Abstract

The purpose of the article is to analyze the development of legislative support for the protection of cultural heritage in the historical settlements of Ukraine and to reflect its features. The scientific novelty of the article is to analyze the main legislation of Ukraine, according to which the legal protection of cultural heritage is carried out in the historical settlements of Ukraine. It is established that the violation of the legislation on the protection of cultural heritage in historical settlements occurs in most settlements due to the lack of approved boundaries and regimes for the use of historical habitats of historical settlements. Conclusions. It is established that the Law of Ukraine "On the Protection of Cultural Heritage" of June 8, 2000 refers to the urban centers that are subject to state protection, historically formed centers of settlements. In accordance with the Law, the Resolution of the Cabinet of Ministers of Ukraine of July 26, 2001 No. 878 approved the List of Historic Settlements of Ukraine, and the Resolution of July 3, 2006 No. 909 - The Procedure for Recognizing a Settlement as Historic. The current legislation of Ukraine in the historical areas of settlements listed in the List of historical settlements of Ukraine prohibits urban development, architectural or landscape transformation, construction, reclamation, road, earthwork without the permission of the body of cultural heritage. The respective boundaries and regimes of use of historical habitats of settlements, as well as restrictions of economic activity are regulated by the Procedure of determining the boundaries and regimes of use of historical habitats of settlements, restriction of economic activity in the territory of historical habitats of settlements, approved by the Cabinet of Ministers of Ukraine of March 13, 2002, according to which the project documentation for new construction, reconstruction and major repairs within the historical habitats of settlements is developed taking into account the requirements of the ...
