LA RESPUESTA DEL TRIBUNAL CONSTITUCIONAL A LOS DECRETOS-LEYES EN MATERIA DE DERECHOS SOCIALES. EL CRITICABLE RETROCESO DE LA JURISPRUDENCIA CONSTITUCIONAL

Abstract

Dentro del marco temporal del periodo del 2008 al 2015 en el que
la crisis económica tuvo su apogeo, se han analizado las sentencias del Tribunal
Constitucional sobre Decretos-Leyes en materia de derechos sociales. Se presta
atención a las argumentaciones de las dos posturas enfrentadas en el seno del Tribunal
que ponen de manifiesto la diferente conceptualización sobre los derechos
sociales, su protección y su regulación. Se destaca también la débil argumentación
jurídico constitucional empleada por la mayoría para sustentar sus posiciones.

bitartera, eta azter ditzagun Konstituzio Auzitegiak eskubide sozialen inguruko
lege‑dekretuen gainean hartu zituen epaiak. Auzitegi barruan badira bi jarrera
kontrajarri, eta batez ere haien arrazoibideak jo ditugu begiz, erakusten dutelako
badela modu bat baino gehiago eskubide sozialak eta haien babesa eta haien
arauketa kontzeptualizatzeko. Gehiengoak darabilen arrazoiketa juridikoa eskasa
da edonola ere, eta hori ere azpimarratu dugu.
In this article are analysed the judgments of the Constitucional
Court on Decrees-law dealing with social rights within the economic crisis from
2008 to 2015. Attention is paid to the constitutional grounds put forward by the
two opposing positions within the Constitutional Court, which highlights the
different concepts of social rights, their protection and their regulation. It also
becomes clear that the majority used weak constitutional grounds to support its
position.
