Der Konstitutionalismus als Bewegungsgeschichte
In: Der Staat: Zeitschrift für Staatslehre und Verfassungsgeschichte, deutsches und europäisches öffentliches Recht, Band 44, Heft 4, S. 571-594
Abstract
In contrast to France or the United States, where constitutionalism was radically created or created from anew, respectively, German constitutionalism of the 19th century added a parliament to a house already occupied by a monarch. In constitutional history, constitutionalism of the 19th century is considered dualistic, with two political powers at times on good terms & at times on bad terms with each other. According to the author, constitutionalism of the 19th century is a political constellation which cannot easily be typified or summarized. The article discusses the research into constitutionalism, including: 1) the central meaning of history of movement; 2) the incorporation of state into this analysis, & 3) a comparison of developments in other European states.
