Abstract

The derailing of popular sovereignty (PS) in Germany is examined, focusing on whether the notion of PS can fulfill its critical function. It is shown that PS emerged as a slogan of the rising bourgeoisie in its struggle against absolutist forms of power. It is also suggested that neither the concept of "the people" nor sovereignty is originally related to either freedom or democracy. The development of PS in the English-speaking world is explored, & it is shown that the original Basic Law of the Federal Republic of Germany is imbued with the liberal spirit of Immanuel Kant's concept of PS.
