Abstract

Some aspects of the structure & functioning of the criminal jury in the US & Spain are compared in this article from the perspective of social & political psychology. Included are jury selection, the geography of the courtroom, witness testimony, the use of experts, the decision rules to be used by juries, & other issues. A major thesis of this discussion is that in the US, with its long history of jury trials, there is currently a very active movement of reform of the way jurors are expected & permitted to conduct their mission in the courtroom. We identify current experimentation being undertaken by some states with actual trials & jurors in the US on changes in jury practices, & we discuss these reforms in US criminal trials in relation to potential changes in the Spanish jury trial. 96 References.
