Abstract

In the discussion of distributive justice, the resulting obstruction of the risks of subjectivity on the one hand, & the rigidity of means & perfectionism on the other hand, can be overcome by a proposal combining distributive criteria of means & capabilities. In this paper I will present the general lines of this project, starting from the key concept of the subject's autonomy, which will enable the differentiation of the operative spheres of the distributive & compensatory criteria of means & capabilities. At the same time, the communitarian dimension plays a prominent role in this proposal, integrating personal behavior to the parameters of justice. For this aspect to contribute to the feasibility of the principles of justice, the characteristics of the communitarian dimension must be specified, moving away from Cohen's proposal & adopting Wellmer proposal of democratic ethos.
