The focus of this paper is public health law and ethics, and the analytic framework advanced in the report Public health: ethical issues by the Nuffield Council on Bioethics. The author criticises the perceived problems found with liberal models associated with Millian political philosophy and questions the Report's attempt to add to such theoretical frameworks. The author suggests a stronger theoretical account that the Council could have adopted-that advanced in the works of Joseph Raz - which would have been more appropriate. Instead of seeking to justify overruling the legitimate interests of individuals in favour of society, this account holds that the interests are necessarily interwoven and thus such a conflict does not exist. It is based on an objective moral account and does not require an excessive commitment to individuals' entitlements.

Synergies between securing sexual rights and the right to health have been pursued where there are clear public health gains to be made, such as lowering incidence of HIV and other sexually transmitted infections (STI). South Africa?s 1996 Constitution outlawed discrimination on the basis of sexual orientation and promoted the right to health. This qualitative health policy analysis sought to understand why and how interventions to improve sexual health of lesbian and bisexual women and address sexual violence were initially proposed in the HIV & AIDS and STI Strategic Plan for South Africa 2007?2011 and why and how these concerns were deprioritised in the National Strategic Plan (NSP) on HIV, STIs and TB 2012?2016. A conceptual framework considered several determinants of political priority for the inclusion in NSP development in 2007 and 2011 around sexual health concerns of women who have sex with women. This article presents findings from 25 in?depth key informant interviews and document review and highlights results of application of categories for a framework on determinants of political priority for lesbian and bisexual women?s issues to be included in South Africa?s NSP including: actor power, ideas, political context and issue characteristics. The article demonstrates how the epidemiological and structural drivers of lesbian and bisexual women?s vulnerability to HIV and STIs, including sexual violence and other violations of their sexual rights, have been expressed in policy forums and whether this has made an impact on lesbian and bisexual women?s ability to claim the right to health.

The 20th century has been described as the bloodiest in human history, but it was also the century in which people around the world embraced ideas of democracy and human rights as never before, constructing social, political and legal institutions seeking to contain human behaviour. Todd Landman offers an optimistic, yet cautionary tale of these developments, drawing on the literature, from politics, international relations and international law. He celebrates the global turn from tyranny and violence towards democracy and rights but also warns of the precariousness of these achievements in the face of democratic setbacks and the undermining of rights commitments by many countries during the so-called 'War on Terror'.

Abstract
Whereas the idea of human rights is often imagined as placing limits on the political sphere from a standpoint outside it, I argue that it is better conceived as a political project that draws authority from its claim to be apolitical. Such an understanding enables us to historicize human rights and to assess it politically and morally, alongside other normative projects. Samuel Moyn has argued that the contemporary understanding of human rights as rooted in the dignity of the person emerged out of twentieth-century Catholic personalist theology. In the latter half of the essay I consider Simone Weil's objections to the personalist conception of dignity and suggest that Weil's idea of an impersonal, sovereign good provides an alternative conception of value.

What novel political spaces emerge at the intersections of global HIV/AIDS interventions and LGBT rights movements? As discrimination and stigma become the targets of global health initiatives, how do communities affected by HIV/AIDS position themselves towards notions of rights? And what is the social and political afterlife of rights-based initiatives after they are defunded or cease to exist? These are the central research questions posed in the dissertation. To address them, I conducted six months of preliminary fieldwork and fifteen months of ethnographic fieldwork in 2012-2015 among gay and transgender communities in the upper Amazonian state of San Martín in Peru. Through data collection techniques that included participant observation and interviews, I examined the social and political effects of a rights-based HIV/AIDS intervention for gay and transgender communities in the region. Among these communities, I found the peche concept to be particularly meaningful. The peche referred to the small gifts that gay and transgender people exchanged for the company, affection, and sex with heterosexual men. While sometimes construed as either a risky sexual practice in HIV/AIDS-related research or considered disempowering by LGBT activists, I found that the peche had historical depth and social extension. I problematize these narratives by developing the concept of peche politics to analyze the political practices that emerged in San Martín among the communities I studied. I situate these practices, such as addressing discrimination and homophobia through formal grievances or recounting and transmitting stories of the internal armed conflict, at the confluence of local myths about sexuality, national histories of violence and human rights, and global health initiatives. In my conclusion, I rethink the local, national, and global scales of this research and propose a hemispheric imaginary to open new analytical possibilities, especially in the moments when global structures of HIV/AIDS initiatives and LGBT rights recede.
