Some preliminary observations on the investment treaty arbitration implications of the Ukraine conflict

This contribution offers some preliminary observations on the investment treaty arbitration implications of the Ukraine conflict. The author reflects on the possibilities of using bilateral investment treaties (BITs) and by extension investment arbitration to obtain compensation for the damages caused by the Russian invasion into Ukraine. Moreover, the author also discusses the possibility that the EU sanctions imposed against Russian natural and legal persons could provide the basis for BITs claims by Russians against EU Member States. Finally, the author calls for the creation of a Ukraine-Russia Claims Tribunal similar to the Iran-US Claims Tribunal for facilitating the payment of awards issued against Russia.
