How can an escalation of conflict lead to negotiation? In this systematic study, Zartman and Faure bring together European and American scholars to examine this important topic and to define the point where the concepts and practices of escalation and negotiation meet. Political scientists, sociologists, social psychologists, and war-making and peace-making strategists, among others, examine the various forms escalation can take and relate them to conceptual advances in the analysis of negotiation. They argue that structures, crises, turning points, demands, readiness and ripeness can often define the conditions where the two concepts can meet and the authors take this opportunity to offer lessons for theory and practice. By relating negotiation to conflict escalation, two processes that have traditionally been studied separately, this book fills a significant gap in the existing knowledge and is directly relevant to the many ongoing conflicts and conflict patterns in the world today

AbstractSystems design principles applied to the United Nations' efforts at international conflict resolution suggest a number of innovative approaches for coordination and harmonization of attempts to move disputants from power to rights to interest‐based solutions. Fifteen suggestions for immediate improvement in U.N. processing of international disputes are presented, along with a recommendation for more sustained and detailed application of systems design principles in order to avoid war, such as the recent conflict in the Persian Gulf.

A decade of divorce mediation research has focused on outcomes such as settlement rates, cost efficiency, client satisfaction, effect on levels of conflict and cooperation, psychological adjustment, and compliance. Despite methodological problems limiting generalizations, most studies report mildly favorable to very positive findings. Research on the mediation process and mediator behaviors has received very limited attention, and should be the focus of the next decade of research to elevate the mediation field to a more sophisticated, effective level of practice.

Abstract: One of the underlying objectives of the reformed civil justice system in Hong Kong is to facilitate the settlement of disputes. The court is now under the duty of active case management to encourage and promote the use of an alternative dispute resolution procedure where appropriate. Facilitative mediation was generally practised in Hong Kong before the Civil Justice Reform. By issuing a specific practice direction on mediation, the judiciary has given a strong boost for this process to the extent that parties may even be penalized in costs if they unreasonably refuse to mediate. The continuous transfer of conflict resolution from the hands of the judge to the parties gives rise to an increasing risk that information disclosed in mediation may be used to the parties' disadvantage in subsequent legal proceedings. This paper examines the precise scope of three common law principles that protect confidentiality of mediation communications. Drawing upon the approaches of local institutions, the US Uniform Mediation Act and the EU Mediation Directive, it considers the arguments that might be relevant in deciding what law should govern the issues at present not covered by the existing legal framework, a question that has become more pressing in view of the fact that negotiations have begun on a proposed mediation ordinance to deal with it. ; published_or_final_version
