Autor objavljuje latinski i kajkavski tekst krajiških povlastica iz 1732., iznosi širi kontekst njihova nastanka u prvoj polovici 18. soljeća i ističe posebnosti ovoga dokumenta. ; The author analyzes text of Statutes of Vlachs published for frontiersmen/Grenzers of Varaždin Generalate in in the 1732 in latin and kajkavian variant of croatian language and compares this document with the older one, the Vlach Statutes / Statuta Valachorum from 1630. year. The aim of this new document was to redefined obligations and rights of frontiersmen in Varaždin Generalate after a long period of social and religious disturbances during first three decades of 18. century. Author points out that the appearance of this document must be considered in context of military reforms in Varaždin Generalate made by Count Caspar Ferdinand von Cordua. He reorganized military structure of Generalate establishing new military units, but reducing the pay of frontiersmen and raising of pay for officers was not acceptable for frontiersmen. Styrian estates although opposed his reforms warning Vienna court that financing of Varasdin Generalate under this circumstances was useless and that well established and equipped frontiersmen army cam also represent potential threat for Monarchy. As for a new Vlach Statutes, they like the old Statuta form 17th century had not consider religious and ecclesiastical issues, but restricted frontiersmens right of free disposition of posessions and forbade buying out military service. Most important change was nomination of military judges (auditors) in seat of every of four captaincies, which have accomplished the duties of previouse supreme judge and eight assessors. Auditors solved different complaints of frontiersmen, including those against military captains (vojvode), and vojvode have got the possibility of making final decisions in quarrels which can be solved without official judicial procedure. Although Vienna Court supported Cordua's plans and promulgated them in 1733 they have been accepted only partialy, but reforms caused disturbancies and resistence of frontiersmen and new Statuta for frontiersmen of Varasdin Generalate were not officialy proclaimed because authorities wanted to keep peace in Military Frontier.

The article examines questions of compensation for non-pecuniary damage as an expression of the state's attitude towards human life. The article introduces the definition of non-pecuniary damage and urges to use provisions of criminal law, instead of civil law, to acknowledge a person as a victim. It also analyses key provisions of compensation for non-pecuniary damage in homicide cases that are related to the totality of objective and subjective elements of offence composition. The author pays particular attention to the issues of legal regulation in determination of the value of non-pecuniary damage and court practice in compensation of non-pecuniary damage. The author believes that Lithuanian society still exalts spiritual suffering, while its material value is hardly recognized, for which the judicial process, which should tackle the question of non-pecuniary damage, often turns into a process where the main concern is the protection of defendant's material welfare and what amount they would be able to pay. The compensation for non-pecuniary damage is not only a question of proving facts, it is foremost the question of the "price" of the murdered. This is why the interests of a victim shouldn't be collated to making a profit of disaster. The court makes decisions in specific cases and applies the legal norms created by the legislator by using facts, logical and rational arguments. By acting in the name of the state and in its interests, the court should firstly take into account the scale of values set by laws and recognized by the state; what is the priority - human life, the victim's pain of loss and suffering or the defendant's age, their material and family status. The court should determine that the defendant killed a person and by doing so they disregarded the highest value, therefore the relatives of the murdered must receive a just compensation. Only in this way the court can clearly set the priority of life over other values; by assessing it adequately, it expresses the state's attitude towards murder.

In this work the author proposes the revision of the labour law supported the decolonial theoretically which part to explore the place and the effectiveness of the right to work in the current power relations and found that, in addition to just be, for now , an instrument which sets the rules of the game for the exploitation of the working class, need you to extend their effectiveness, in order to contain and regulate, perspectives infrequently explored by this field of law, namely: (1) the question of the races in Latin America which is before and goes beyond classical inequality of classes that is intended to correct, or at least mitigate by labour standards; (2) the question of genre, which the author raises not as an added question if not primary to understand relations of exploitation and (3) the issue of the democratization of public authority in the hands of the State through a racial reinterpretation of the political participation as budget of the same democratization of labour relations. ; En este trabajo el autor propone la revisión del Derecho del trabajo apoyado en la teoría decolonial, de la que parte para explorar el lugar y la eficacia del Derecho del trabajo en las relaciones actuales de poder y halla que, además de sólo ser, por ahora, un instrumento que sienta las reglas del juego para la explotación de la clase trabajadora, le hace falta extender su eficacia, en aras de contener y regular, perspectivas exploradas pocamente por este ámbito del derecho, a saber: (1) la cuestión de las razas en Latinoamérica que está antes y va más allá de la clásica desigualdad de clases que se pretende corregir o, al menos, mitigar mediante las normas laborales; (2) la cuestión de género, la que el autor plantea no como una cuestión adicional si no principal para comprender las relaciones de explotación y (3) la cuestión de la democratización de la autoridad pública en manos del Estado a través de una relectura racial de la participación política como presupuesto de la democratización misma de las relaciones de trabajo.

The article analyzes the processes of establishment of the Ukrainian model of local selfgovernment in the context of its historical development. The author attempted to create a periodization of key stages of forming the models of local self-government in Ukraine, basing it on substantial historical and political analysis. The author expresses the opinion that Ukrainian local self-government has passed six stages of its development: the Kievan Rus model, the colonial model, the national model, the soviet model, the model of "Perestroyka" and the modern hybrid model. It has been proved that the establishment of the national model of local self-government depends on the concrete conjecture of the sociopolitical process. It has been established that the peculiarities of the national development of local self-government is a derivative of socioeconomic development of the regions and the state in general. ; В представленном исследовании анализируются процессы становления украинской модели местного самоуправления в контексте его исторического развития. Осуществляется попытка на основе комплексного исторического и политического анализа создать периодизацию основных этапов формирования моделей местного самоуправления в Украине. Высказывается позиция, что украинское местное самоуправление прошло 6 этапов своего развития: модель Киевской Руси, колониальная модель, национальная модель, советская модель, модель перестройки и современная гибридная. Доказано, что становление национальной модели местного самоуправления зависит от конкретной конъектуры в общественно-политическом процессе. Установлено, что специфика национального развития местного самоуправления является производной величиной социально-экономического развития регионов и государства в целом. ; У статті досліджена специфіка формування національної моделі місцевого самоврядування в Україні крізь призму історії та сучасності. Виявлено основні етапи розвитку та формування української моделі місцевого самоврядування в контексті зарубіжного досвіду та вітчизняних наукових практик. Визначено головні орієнтири трансформації національної моделі місцевого самоврядування в контексті історичного розвитку української державності. Узагальнено науково-практичний досвід дослідження місцевого самоврядування в Україні. Зроблено висновок, що національна модель місцевого самоврядування в Україні ще перебуває у стані свого формування і цей процес відбувається під впливом зовнішніх і внутрішніх загроз української державності.

One of the major tools and conditions of modernization and transition to investment development is carrying out effective investment policy by the state in the field of the state capital investments. In the conditions of limitation of financial resources of means of the state, according to the author, have to go first of all to such forms of capital construction as modernization and modernization of the existing research and production base.Meanwhile contradictions and shortcomings of the developed conceptual framework in financing of the state capital investments create considerable difficulties in the solution of a problem of ensuring rhythmical and effective financing from the budget of modernization and modernization. In the article the author considers concepts of modernization, new construction, reconstruction and modernization, expansion of production and their reflection in the current legislation and standard and legal documents, shows discrepancy of interpretation of these concepts in different legislative and normative legal acts that results in difficulties in practical activities on implementation of the state capital investments. The reasons of the developed situation are analyzed and offers on its correction are made. ; Одним из важнейших инструментов и условий модернизации и перехода на инвестиционное развитие является проведение государством эффективной инвестиционной политики в области государственных капитальных вложений. В условиях ограниченности финансовых ресурсов средства государства, по мнению автора, должны направляться в первую очередь в такие формы капитального строительства, как техническое перевооружение и модернизация существующей научно-производственной базы.Между тем противоречия и недостатки в сложившемся понятийном аппарате в финансировании государственных капитальных вложений создают значительные трудности в решении задачи обеспечения ритмичного и эффективного финансирования из бюджета технического перевооружения и модернизации. В своей статье автор рассматривает понятия технического перевооружения, нового строительства, реконструкции и модернизации, расширения производства и их отражение в действующем законодательстве и нормативно-правовых документах, показывает противоречивость трактовки этих понятий в разных законодательных и нормативно-правовых актах, что приводит к трудностям в практической деятельности по осуществлению государственных капитальных вложений. Анализируются причины сложившегося положения дел и вносятся предложения по его исправлению.

В статье автор рассматривает некоторые проблемы квалификации описания состава преступления и классификации убийства матерью новорождённого ребенка по отечественному законодательству. В работе рассмотрены как уже изученные и проанализированные материалы по проблемам квалификации данного состава, так и самостоятельно сделанные выводы, отмеченные в ходе исследования. На основе проведённого анализа автором разработаны рекомендации по совершенствованию действующего законодательного и правоприменительного подхода в данной области. В действующем Уголовном кодексе Российской Федерации по данной статье существует множество проблем для правоприменителя, а именно проблемы, связанные с точной регламентацией ряда моментов и понятий. В исследуемой статье затронуты проблемы, связанные с определением начала жизни, окончания жизни, периода новорождённости, ответственностью за преступление, совершённое в соучастии, а также за убийство матерью двух и более новорождённых детей. Немаловажным является и раскрытие условий психотравмирующей ситуации как одного из альтернативных действий объективной стороны преступления. ; In the article, the author considers some problems of qualifying the description of the crime and the classification of the murder of the newborn baby's mother under the national legislation. The paper considers both the materials that have already been studied and analyzed materials on the problems of qualification of this composition, as well as independently drawn conclusions noted in the course of the study. Based on the analysis, the author developed recommendations on improving the current legislative and law enforcement approach in this area. There are many problems for law enforcement on this article in the current Criminal Code of the Russian Federation, exactly the problems associated with the exact regulation of a number of times and concepts. The article touches the problems associated with determination of the beginning of life, the end of life, the period of newborns, the responsibility for the crime that committed in complicity, as well as for the murder by the mother of two or more newborns. The important thing here too is the disclosure of the conditions of the psychotraumatic situation, as one of the alternative actions of the objective side of the crime.

У статті сформульовано два підходи до розуміння професії «політолог» в Україні — фаховий і дилетантський. Визначено види впливу політологів на політичні процеси: позитивний, негативний, нейтральний; свідомий і несвідомий; безпосередній і опосередкований. На думку автора, з метою збільшення позитивного впливу політологів на практичну політику необхідно формувати фахове середовище висококваліфікованих, об'єктивних, відповідальних за розвиток своєї держави політологів. ; Theoretical and practical aspects of activity of political scientists in Ukraine are considered in this article. The author analyzes lists of kinds of activities of political scientists, which are noted on the sites of higher educational establishments of Ukraine and in the National Classifier of Professions. After the collapse of the Soviet Union, in the first decade of independent Ukraine, known in society became persons, who began to position themselves as political scientists, although were historians, philosophers and even theoretical physicists etc. Most of them worked as political technologists for certain politicians or political parties. They often appeared in the media in order to promote the interests of their customers. As a result, political scientists began to be associated with political technologists. The situation after the Revolution of Dignity has changed a bit. In particular, there are a huge number of diploma political scientists, who have more opportunities to get into the media space. Two approaches to understanding profession «political scientist» in Ukraine — professional and dilettantish are formulated in this article. The author defines kinds of influence political scientists on political processes: positive, negative, neutral; conscious and unconscious; direct and indirect. In the author's opinion, in order to increase the positive influence of political scientists on practical policy, it is necessary to create a professional environment of highly skilled, objective, responsible for the development of state, political scientists. ; В статье сформулированы два подхода к пониманию профессии «политолог» в Украине — профессиональный и дилетантский. Определены виды влияния политологов на политические процессы: положительное, отрицательное, нейтральное; сознательное и несознательное; непосредственное и косвенное. По мнению автора, с целью увеличения положительного влияния политологов на практическую политику необходимо формировать профессиональную среду высококвалифицированных, объективных, ответственных за развитие своего государства политологов.

The author analyzes the donation charter by which a noble couple, Ulrich II and his wife Adelaide, gifted numerous properties in Istria to the Church of Aquileia for the salvation of their souls (16th November, 1102). Inspired by the studies of Marcel Mauss, the donation is contextualized as a "total social fact" and the study investigates other, previously unarticulated aspects of this gift. The author investigates the contemporary political and social background, primarily focusing on the protagonists' position in respect to the two seminal alliances of their era, the pro-papal and pro-Henrician forces during the Investiture Controversy. In this way, it is concluded that Ulrich II. endowed a religious institution that gathered pro-imperial forces, governed by a loyal and fierce supporter of Henry IV, Ulrich Eppenstein. Since Ulrich II died without any children, the only heirs to the properties he left to the Church would have been his brother's children or his distant relatives in Thuringia. However, his brother Poppo II married into a family supporting the papacy, the Spanheims. After Poppo's death and the remarriage of his widow, Ulrich II. donated the property so as not to render possible any future claims to the inheritance either by the nearby Spanheims or the Ballenstedts, his relatives in Thuringia known for rebelling against Henry IV. Thus, a new aspect of the well-known donation charter emerges. Since the gift is viewed as a "total social fact", it is concluded that Ulrich II both demonstrated his allegiance during the decisive conflict of his era, reaffirmed his superior social position of a wealthy nobleman, positioned himself along the pro-imperial forces gathered around the Patriarchate of Aquileia, ensured his father's properties would not fall into the hands of the enemies of Henry IV and made ample provisions for the salvation of his soul. The article concludes with a new transcription of the charter and its translation into modern English.

На основе делопроизводственного и законодательного материалов анализируется функционирование системы содержания и строительства мостов в Томской губернии в конце XIX – начале XX в. на средства губернского земского сбора. Отсутствие в государственном законодательстве четких критериев не позволяло уездным и волостным властям точно отнести тот или иной мост к числу финансируемых из средств губернского земского сбора. Это порождало практику подачи в Томское губернское управление недостаточно мотивированных ходатайств о постройке сооружений за общегубернский счет. Автор показывает, что для рационализации деятельности по составлению трехлетних губернских земских смет Томским губернским управлением издавались инструкции и циркуляры. Составленные губернским управлением сметы получали утверждение высших государственных органов власти. Автор высказывает тезис о значительной диспропорции между пожеланиями уездной администрации и возможностями губернского управления в финансировании строительства и содержания мостов из губернских земских сборов. Существовала практика сверхсметного ассигнования средств на неотложные ремонтно-строительные работы.DOI 10.14258/izvasu(2017)2-19 ; On the basis of the archival materials and legislation the article provides the analysis of the functioning of the system of the maintenance and the constructing of the bridges in the Tomsk province at the expense of the provincial local tax in the late 19th early 20th century. The lack of clear criteria for the national legislation did not allow the county and township authorities to accurately attribute this or that bridge to the one of those financed by the provincial local tax. This gave rise to the practice of supplying not enough motivated applications to the Tomsk provincial management of the construction of the facilities at the expense of the whole province. The author shows that to streamline the preparation of three-year provincial local budgets, the Tomsk provincial administration issued instructions and circulars. Structured management of the provincial budget received approval of the highest state authorities. The author expresses the thesis of a significant imbalance between the wishes of the county administration and the capabilities of the provincial administration in the financing of construction and maintenance of bridges from provincial local taxes. На основе положений юридической науки, действующего законодательства, а также материалов правоприменительной практики анализируется такой правовой режим конфиденциальности информации, как банковская тайна. Действующее законодательство наиболее широко определяет круг сведений, составляющих банковскую тайну. В подобной ситуации суды нередко прибегают к расширительному толкованию и склонны относить к банковской тайне также и общедоступную информацию либо информацию, подпадающую под действие иных правовых режимов конфиденциальности. В статье сформулирован вывод о том, что такая общедоступная информация, как информация о номере банковского счета субъекта предпринимательской деятельности, не может быть отнесена к числу сведений, составляющих банковскую тайну. Предлагается на информацию о клиенте кредитной организации, являющемся физическим лицом, распространять не режим банковской тайны, а только режим персональных данных. Критически оценивается предусмотренное законодательством о банковской деятельности право кредитной организации самостоятельно относить к сведениям, составляющим банковскую тайну, иную информацию, в связи с чем предлагается указанное право исключить из норм Федерального закона «О банках и банковской деятельности».DOI 10.14258/izvasu(2016)3-28 ; The article contains general analysis of legal science, modern Russian legislation and established practice in applying the law concerning such confidential information legal regime as bank secrecy. Modern Russian legislation gives a sufficient definition to the information constituting bank secrecy. In this situation, the courts often resort to broad interpretation and tend to refer to banking secrecy publicly available information or the information subjected to other legal regimes of confidentiality. The article provides the conclusion that publicly available information on the entrepreneur's bank account cannot be referred to the information constituting bank secrecy. The author comes up with the proposal to apply to the individual, a customer of credit institution, not the banking secrecy regime, but the regime of personal data. Critical assessment is given to the right of the credit organization, provided by the legislation on bank activity, to independently classify other information as bank secrecy. The author points out that above mentioned credit organization right should be excluded from the federal act "On the Banks and Banking Activiy".DOI 10.14258/izvasu(2016)3-28

Статья посвящена актуальной проблеме позиционирования страны на международной арене с помощью инструментов государственной политики. Государственная политика Республики Беларусь по созданию и продвижению позитивного имиджа страны на международной арене рассматривается в связи с проблемой формирования положительного образа Республики Беларусь в целом. Автором выделяются основные этапы государственной политики в сфере имиджирования, анализируются основные инструменты, используемые государством в процессе формирования позитивного имиджа страны, делается вывод о степени эффективности имиджевой политики Республики Беларусь. Кроме того, в статье подробно исследован и проанализирован период сотрудничества государственных структур Республики Беларусь с международной компанией Bell Pottinger Group, которая занималась улучшением имиджа республики и ее президента в 2008–2009 гг. Делается вывод о сложившемся в странах Западной Европы негативном образе Республики Беларусь, что во многом обусловлено отсутствием ее целостного внутреннего образа, инвариантностью внешнего образа республики, а также нескоординированной и непродуманной имиджевой политикой белорусских властей. The state policy of the Republic of Belarus on the creation and promotion of a positive image of the country in the international arena is considered in connection with the problem of formation of a positive image of the Republic of Belarus. The author detects the main milestones of the state policy in the promotion sphere, analyzes main tools of promoting the process and also comes to conclusion about the effectiveness of Belarus image policy. Furthermore, the article examines and analyzes the period of partnership between government of the Republic of Belarus and Bell Pottinger Group — the international company that tried to upgrade the image of the Republic of Belarus and the president in 2008-2009. The author comes to the conclusion about the negative image of the Republic of Belarus in the European countries which resulted from the lack of integrity of the inner image of Belarus, the invariance of the external image of the Republic of Belarus, as well as uncoordinated and ill-conceived image policy of the Belarusian authorities. Objective. We examined the significance of the text "Advis pour dresser une bibliothèque", written by Gabriel Naudé in 1627. This is considered one of the major contributions for the formation of Librarianship. Design/Methodology/Approach. As perspective, we deepen into the historical coordinates where the author and his work are located, examining some variables that influenced this process. The analysis was carried out by investigating an empirical universe of documents. Results/Discussion. The personal, social and political circumstances of the author have been discussed, and their incidence in the library, bibliographic and political work produced by Gabriel Naudé.Conclusions. The "Advis pour dresser une bibliothèque" constituted the major Naudean contribution to Librarianship, where Naudé systematized the library practice of his time, and also sat bases for what later would be known as Library Science. Originality/Value. This study illustrated the historical significance of Gabriel Naudé as librarian, bibliographer, and political theorist, highlighting the interrelationship of these facets of his intellectual activity. ; Objetivo. Se examinó la significación del texto "Advis pour dresser une bibliothèque", elaborado por Gabriel Naudé en 1627. Esta obra es considerada como una de las contribuciones fundamentales en la conformación de la Bibliotecología.Diseño/Metodología/Enfoque. Como perspectiva nos adentramos en las coordenadas históricas en las que se sitúan el autor y su obra, para lo cual se examinaron determinadas variables que incidieron en ese proceso. El análisis se efectuó mediante una indagación que tuvo como universo empírico a los documentos.Resultados/Discusión. Han sido discutidas las circunstancias personales, sociales y políticas de que develan la incidencia de éstas en la obra bibliotecaria, bibliográfica y política que fue capaz de producir Gabriel Naudé.Conclusiones. El "Advis pour dresser une bibliothèque" constituyó el mayor aporte Naudeano a la Bibliotecología. Con este manual, Naudé sistematizó la práctica bibliotecaria de su tiempo y sentó las bases para lo que posteriormente sería la Ciencia de la Biblioteca.Originalidad/Valor. Este estudio ilustró la significación histórica de Gabriel Naudé como bibliotecario, bibliógrafo y teórico de la política, donde se dan elementos que buscaron anotar la interrelación existente entre esas facetas de su actividad intelectual.

The article is mainly devoted to the processes that happened in the Republic of Belarus after the demise of the Soviet Union. A comprehensive study was made of Belarusian national identity and new state symbols. The process of national identity formation in Belarus is studied in terms of the establishment of new state symbols. The interaction of government and society in developing the national idea and symbols of independence is thoroughly analyzed. Special emphasis is laid on Litvin and Soviet identities, which were the foundation of shaping various types of Belarusian identity. The government's efforts in the sphere of developing national history, ideology and identity are also considered in this article. The author comes to the following conclusions. First, the process of adopting new state symbols could be divided into 2 periods: the first is from 1991 to 1994 and the second is from 1994 to 1995. The period from 1991 to 1994 is characterized as a period of construction of new national identity based on the opposition to the Russian statehood. The author also concludes that the government's efforts to develop national identity failed and as a result a specific type of identity was formed that can be named «quasi-Soviet identity».DOI 10.14258/izvasu(2015)2.1-41 ; Статья посвящена изучению процессов формирования национальной идентичности белорусов и принятия новой государственной символики после распада СССР. Процесс складывания национальной идентичности рассматривается сквозь призму установления новой национально-государственной символики, исследуется взаимодействие власти и общества в вопросе выработки национальной идеи и символов независимости (флаг и герб). Особое внимание уделено литвинской и советской идентичностям, на основе которых и происходило формирование различных видов белорусской национальной идентичности. Автор приходит к выводу, что процесс принятия новой государственной символики Республикой Беларусь может быть разделен на два этапа: 1991– 1994 и 1994– 1995 гг., для первого из которых было характерно построение национальной идентичности по принципу противопоставления российской государственности. Отмечается, что попытки построения национальной идентичности со стороны белорусских властей были не совсем удачными и привели в итоге к формированию в общегосударственном смысле особого типа идентичности — квазисоветской идентичности.DOI 10.14258/izvasu(2015)2.1-41

The paper considers the views of the founders of the Slavophilism (A.S. Homjakov, I.V. Kireyevsky, K.S. Aksakov, Y.F. Samarin) to the problem of balance between the interests of society and the state. Slavophile interpretation of this issue compared with the values of the world's leading political ideologies — conservatism, liberalism and socialism. In particular, it analyzes the liberal concept of "civil society" and Slavophile concept of "land". In addition, revealed the meaning of Slavophile concepts as "citizenship" and "civic life". The author cites a number of researchers and philosophers of the past and present quotes about of the place and role of the Slavophiles in the political and ideological spectrum in Russia and Europe. The main idea of the article is that having some common ground in this aspect with the liberal, conservative and socialist ideologies Slavophilism expressed originality of Russian culture and Russian political tradition. This originality can be traced, in particular, in the views of the Slavophiles on the popular representation as a way of citizen participation in politics, in their assessment of personal and people's freedom. Хомякова, И.В. Киреевского, К.С. Аксакова, Ю.Ф. Самарина) на проблему соотношения интересов общества и государства. Славянофильская трактовка этого вопроса сопоставляется с ценностями ведущих мировых политических идеологий — консерватизма, либерализма и социализма. В частности, анализируются либеральное понятие «гражданское общество» и славянофильское понятие «земля». Кроме того, выявляется смысл таких славянофильских концептов, как «гражданственность» и «гражданская жизнь». Автор приводит высказывания целого ряда исследователей и философов прошлого и современности относительно места и роли славянофильства в политико-идеологическом спектре России и Европы. Основная мысль статьи заключается в том, что, имея определенные точки соприкосновения в рассматриваемом аспекте с либеральной, консервативной и социалистической идеологиями, славянофильство выразило своеобразие русской культуры и русской политической традиции. Это своеобразие прослеживается, в частности, в воззрениях славянофилов на народное представительство как способ участия граждан в политике, в их оценке личной и народной свободы.
