Opinions over the purpose & importance of international law in the age of globalization & democratic & effective governance beyond the national state differ widely. High expectations have been placed on the UN, which now depend on the member states to make something of such an important framework. The largely failed attempts at UN-reform require a fundamental rethinking of central questions of the international system, including the structural ambivalence between international law & international politics. The concept of global governance, different from that of global government, is a lengthy process of international law arrangements in the tense relationship between law & politics, where the UN as its institutional center plays a key role. The challenging adaptations can not be unilaterally dictated, but require broad global acceptance that the UN can offer, though trends in international politics may increasingly discredit the UN & multilateral cooperation. The need for reform in no way negates the fact that the UN is indispensable for the stability of the international system, & that despite its weaknesses, it has shown itself to be an institution that can react flexibly to new & old challenges, depending on what the member states make of it. Jurisprudence has up until recently largely neglected international law as a subject of philosophizing. The Nature of International Law tries to offset against this deficiency by providing a comprehensive explanatory account of international law. It does so within an analytical tradition, albeit within the one which departs from the nowadays dominant method of the metaphysically-driven conceptual analysis. Instead, it adopts the prototype theory of concepts, which is directed towards determining typical features constitutive of the nature of international law. The book's central finding is that those features are: normativity, institutionalization, coercive guaranteeing, and justice-aptness. Since typical features are context sensitive, their specificities at the international level are further elucidated. The book, finally, challenges the often raised claim that fragmentation is international law's unique feature by demonstrating that international institutional actors, particularly adjudicative ones, largely perceive themselves as officials of a unified legal order.

Im Internationalen Investitionsrecht haben NGOs und sonstige nichtstaatliche Akteure den amicus curiae brief für sich entdeckt, um auf bestimmte Folgewirkungen eines Schiedsspruchs hinzuweisen. Auch die Europäische Kommission tritt in Investitionsverfahren verstärkt als amicus curiae in Erscheinung.Der lateinische Begriff amicus curiae bedeutet übersetzt "Freund des Gerichts". Es handelt sich um ein Rechtsinstitut, das dem angloamerikanischen Prozessrecht entstammt. Es erlaubt verfahrensfremden Dritten, sich mittels eines Schriftsatzes (engl.: "brief") in ein gerichtliches Verfahren einzuschalten und rechtlich Stellung zu nehmen.Das Buch geht auf die historische Entwicklung des amicus briefs ein und analysiert die Rechtsgrundlagen des amicus briefs im Investitionsrecht sowie seine Akzeptanz in der Schiedsgerichtspraxis. Es werden konkrete Vorschläge zur Optimierung der Rechtslage unterbreitet und Handlungsempfehlungen an die Akteure im internationalen Investitionsrecht ausgesprochen
