(DÜI-Spe)

"Are social practices actions, or institutional frameworks of interaction structured by common rules? How do social practices such as signing a cheque differ from international practices such as signing a peace treaty? Traversing the fields of International Relations (IR) and philosophy, this book defends an institutionalist conception of practices as part of a general practice theory indebted to Oakeshott, Wittgenstein and Hegel. The proposed practice theory has two core aspects: practice internalism and normative descriptivism. In developing a philosophical analysis of social practices that has a special relevance for international relations, Silviya Lechner and Mervyn Frost depart from Pierre Bourdieu's sociology of practice that dominates the current 'practice turn' in IR. The authors show that the contemporary global realm is constituted by two distinct macro practices- the practice of sovereign states and that of global rights"--

The subject of this work is the rise and fall of Europe's aim to rebuild its position in global politics after the Cold War. With success in the unification of Europe and the subsequent deepening and enlargement of its integration, the Union set itself the ambitious task of becoming a global power, even a superpower. However, starting with the first decade of the XXI century, we have witnessed a rapid erosion of the international position of Europe (the EU). The author carefully analyses the causes of the EU's failure in pursuing the role of European representative, Europe thereby pretending to the role of one of three world powers. Besides cultural and demographic trends, the author identifies the main factors leading to this failure: the divergent interests of individual European powers, their incapacity to act in a geopolitical context and the rapid erosion of Europe's civilizational identity. The rapid decline of Europe's international position threatens the appearance of a new and bipolar global arrangement together with the further marginalisation of Europe.

The purpose of the article is to assess how the provisions resulting from international programmatic norms in the field of human genetic data are implemented. The presented study, adopting the perspective of institutional rationalism extended to the paradigm of legalism, considers examples of the implementation of these standards in selected legal systems – Germany, the United States of America and France. The selection of the research paradigm is preceded by a theoretical introduction, which presents three ways of conceptualizing the notion of soft law in the legal sciences. Following an outline of this legal regime in positivism, and the theories of rationalization and constructivism, the author focuses on the provisions of the International Declaration on Human Genetic Data of 16 October, 2003, which are compared with the legislative initiatives of Germany, the United States of America and France, to show the influence that the choices of states has on selection of the implemented standards and how they are implemented.
